Amends the Criminal Identification Act. Provides that every county medical examiner and coroner shall provide to the Department of State Police a sample of saliva or tissue from a dead body for DNA fingerprint analysis if the Department notifies the medical examiner or coroner that the Department has determined that providing that sample may be useful for law enforcement purposes in a criminal investigation. Also provides that if a local law enforcement agency notifies a county medical examiner or coroner that such a sample would be useful in a criminal examination, the county medical examiner shall provide a sample to both the Department and the local law enforcement agency.

| AN ACT concerning criminal law.

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Criminal Identification Act is amended by |
5 |
| adding Section 9.5 as follows: |
6 |

| Sec. 9.5. Sec. 9.5. Material for DNA fingerprint analysis. |

| Every county medical examiner and coroner shall provide to the |
9 |
| Department a sample of saliva or tissue from a dead body for |
10 |
| DNA fingerprint analysis if the Department notifies the medical |
11 |
| examiner or coroner that the Department has determined that |
12 |
| providing that sample may be useful for law enforcement |
13 |
| purposes in a criminal investigation. In addition, if a local |
14 |
| law enforcement agency notifies a county medical examiner or |
15 |
| coroner that such a sample would be useful in a criminal |
16 |
| examination, the county medical examiner shall provide a sample |
17 |
| to both the Department and the local law enforcement agency.
