1     AN ACT concerning transportation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Vehicle Code is amended by changing
5 Section 3-100 as follows:
 
6     (625 ILCS 5/3-100)  (from Ch. 95 1/2, par. 3-100)
7     Sec. 3-100. Definitions. For the the purposes of this
8 Chapter, the following words shall have the meanings ascribed
9 to them:
10     "Electronic" includes electrical, digital, magnetic,
11 optical, electromagnetic, or any other form of technology that
12 entails capabilities similar to these technologies.
13     "Electronic record" means a record generated,
14 communicated, received, or stored by electronic means for use
15 in an information system or for transmission from one
16 information system to another.
17     "Electronic signature" means a signature in electronic
18 form attached to or logically associated with an electronic
19 record.
20     "Owner" means a person who holds legal document of
21 ownership of a vehicle, limited to a certificate of origin,
22 certificate of title, salvage certificate, or junking
23 certificate. However, in the event a vehicle is the subject of

1 an agreement for the conditional sale or lease thereof with the
2 right of purchase upon performance of the conditions stated in
3 the agreement and with an immediate right of possession vested
4 in the conditional vendee or lessee, or in the event a
5 mortgagor of such vehicle is entitled to possession, then such
6 conditional vendee or lessee or mortgagor shall be deemed the
7 owner for the purpose of this Chapter, except as provided under
8 paragraph (c) of Section 3-118.
9     "Record" means information that is inscribed, stored, or
10 otherwise fixed on a tangible medium or that is stored in an
11 electronic or other medium and is retrievable in perceivable
12 form.
13     "Signature" or "signed" includes any symbol executed or
14 adopted, or any security procedure employed or adopted, using
15 electronic means or otherwise, by or on behalf of a person with
16 intent to authenticate a record.
