AMENDMENT TO SENATE BILL 1226

2     AMENDMENT NO. ______. Amend Senate Bill 1226 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Clinical Psychologist Licensing Act is
5 amended by adding Section 11.5 as follows:
 
6     (225 ILCS 15/11.5 new)
7     Sec. 11.5. Temporary authorization of practice by persons
8 licensed in other jurisdictions.
9     (a) The Department, in its discretion, may issue a
10 temporary permit authorizing the rendering of clinical
11 psychological services, as defined in Section 2 of this Act, in
12 this State for up to 10 calendar days per year, consecutively
13 or in aggregate. This temporary permit may be issued to an
14 individual who is licensed in good standing to practice
15 psychology independently and at the doctoral level in another
16 state, province, or territory. Any portion of a calendar day in

1 which the psychologist provides services in this State is
2 considered one working day. In no case shall a person
3 practicing pursuant to this subsection (a) establish a
4 permanent office location in Illinois, nor prepare or publish
5 letterhead, business cards, or similar publicity materials
6 listing an Illinois address or Illinois-based phone number.
7 Time devoted to providing testimony in court or in deposition
8 shall not be counted as part of the 10 calendar days allowed
9 under this subsection (a).
10     An applicant for a temporary permit under this subsection
11 (a) must apply to the Department on forms and in the manner
12 prescribed by the Department. The application shall require
13 that the applicant submit to the Department (i) satisfactory
14 proof that the applicant is licensed in good standing to
15 practice psychology independently and at the doctoral level in
16 another state, province, or territory, including the sworn
17 statement of the applicant that his or her license is not
18 encumbered in any manner by any licensing authority, (ii) the
19 name of the state, province, or territory in which the
20 applicant is licensed, and (iii) the applicant's license number
21 or other appropriate identifier issued by the licensing
22 authority to the applicant.
23     (b) The Secretary may temporarily authorize an individual
24 to practice clinical psychology who (i) holds an active,
25 unencumbered license in good standing in another jurisdiction
26 and (ii) has applied for a license under this Act due to a

1 natural disaster or catastrophic event in the jurisdiction in
2 which he or she is licensed. The temporary authorization
3 granted under this subsection (b) expires upon the issuance of
4 a license under this Act or upon the notification that
5 licensure has been denied by the Department.
6     (c) Any psychologist practicing pursuant to subsection (a)
7 or (b) of this Section shall conform his or her practice to the
8 mandates of and shall be subject to the prohibitions and
9 sanctions, as well as the provisions on hearings and
10 investigations, contained in this Act and any rules adopted
11 thereunder while he or she is practicing in this State.".
