Amends the Illinois Highway Code. Provides that any recipient of State funds shall give the highest priority to the use of energy efficient lights in any traffic control devices funded by State moneys. Limits home rule powers. Amends the State Mandates Act to require implementation without reimbursement by the State. Effective immediately.

| AN ACT concerning transportation.
|

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Illinois Highway Code is amended by adding |
5 |
| Section 9-131 as follows: |

| (605 ILCS 5/9-131 new)

| Sec. 9-131. Energy efficient lighting. |
8 |
| (a) Definitions. As used in this Section: |
9 |
| (1) "Energy efficient lights" means light emitting |
10 |
| diode traffic lights or other lights that the Department of |
11 |
| Transportation shall find to be as or more energy efficient |
12 |
| that light emitting diode lights. |
13 |
| (2) "Highest priority" means that the priority shall be |
14 |
| given as specified unless the Department of Transportation |
15 |
| finds that giving such priority will cause an unreasonable |
16 |
| burden. |

| (3) "Recipient" means any unit of government including |
18 |
| but not limited to counties, townships and municipalities |
19 |
| that receive State funds for construction, maintenance, or |
20 |
| rehabilitation of any roads or highways, or for the design, |
21 |
| construction, or maintenance of any road or highway |
22 |
| intersections, or for the purchase, installation, |
23 |
| rehabilitation or maintenance of any traffic control |
