1     AN ACT concerning housing.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Shelter Residents Protection Act is amended
5 by changing Section 5 as follows:
 
6     (310 ILCS 80/5)
7     Sec. 5. Homeless persons; savings.
8     (a) If a homeless person resides at a shelter, that that
9 person may open a passbook savings account at a bank or savings
10 and loan association subject to the requirements imposed by the
11 bank or savings and loan association. In the alternative, the
12 homeless person may enter into a written agreement with the
13 shelter in which he or she resides; the agreement may provide
14 that the shelter will accept and hold moneys belonging to the
15 homeless person. Under such an agreement, the shelter shall do
16 the following:
17         (1) Place the moneys in a non-interest bearing account
18     for the homeless person, at no cost to that person.
19         (2) Segregate, from all other moneys or accounts held
20     or maintained by the shelter, moneys accepted from and held
21     for homeless persons.
22         (3) Maintain, separately for each homeless person with
23     whom an agreement is made under this Section, an accurate

1     accounting of the moneys accepted from, held for, and
2     withdrawn by that person. Upon a homeless person's request,
3     the shelter shall provide a copy of the accounting
4     concerning that person's moneys.
5         (4) Pay to the homeless person, within 48 hours after
6     the person's request, the amount of the person's moneys
7     held by the shelter or any lesser amount requested by the
8     homeless person.
9     (b) Money held by a shelter under this Section shall not be
10 subject to assignment, attachment, garnishment, set-off, or
11 other process in aid of creditors.
12     (c) For purposes of this Section, "homeless person" means
13 either of the following:
14         (1) An individual who lacks a fixed, regular, and
15     adequate nighttime residence; or
16         (2) An individual who has a primary nighttime residence
17     that is any of the following:
18             (A) A supervised publicly or privately operated
19         shelter designed to provide temporary living
20         accommodations (including welfare hotels, congregate
21         shelters, and transitional housing for the mentally
22         ill).
23             (B) An institution that provides a temporary
24         residence for individuals intended to be
25         institutionalized.
26             (C) A public or private place not designed for, or

1         ordinarily used as, a regular sleeping accommodation
2         for human beings.
