AMENDMENT TO SENATE BILL 790

2     AMENDMENT NO. ______. Amend Senate Bill 790, AS AMENDED, by
3 replacing everything after the enacting clause with the
4 following:
 
5     "Section 5. The State Employees Group Insurance Act of 1971
6 is amended by changing Section 11 as follows:
 
7     (5 ILCS 375/11)  (from Ch. 127, par. 531)
8     Sec. 11. The amount of contribution in any fiscal year from
9 funds other than the General Revenue Fund or the Road Fund
10 shall be at the same contribution rate as the General Revenue
11 Fund or the Road Fund, except that in State Fiscal Year 2009 no
12 contributions shall be required from the FY09 Budget Relief
13 Fund. Contributions and payments for life insurance shall be
14 deposited in the Group Insurance Premium Fund. Contributions
15 and payments for health coverages and other benefits shall be
16 deposited in the Health Insurance Reserve Fund. Federal funds

1 which are available for cooperative extension purposes shall
2 also be charged for the contributions which are made for
3 retired employees formerly employed in the Cooperative
4 Extension Service. In the case of departments or any division
5 thereof receiving a fraction of its requirements for
6 administration from the Federal Government, the contributions
7 hereunder shall be such fraction of the amount determined under
8 the provisions hereof and the remainder shall be contributed by
9 the State.
10     Every department which has members paid from funds other
11 than the General Revenue Fund, or other than the FY09 Budget
12 Relief Fund in State Fiscal Year 2009, shall cooperate with the
13 Department of Central Management Services and the Governor's
14 Office of Management and Budget in order to assure that the
15 specified proportion of the State's cost for group life
16 insurance, the program of health benefits and other employee
17 benefits is paid by such funds; except that contributions under
18 this Act need not be paid from any other fund where both the
19 Director of Central Management Services and the Director of the
20 Governor's Office of Management and Budget have designated in
21 writing that the necessary contributions are included in the
22 General Revenue Fund contribution amount.
23     Universities having employees who are totally compensated
24 out of the following funds:
25         (1) Income Funds;
26         (2) Local auxiliary funds; and

1         (3) the Agricultural Premium Fund
2 shall not be required to submit such contribution for such
3 employees.
4     For each person covered under this Act whose eligibility
5 for such coverage is based upon the person's status as the
6 recipient of a benefit under the Illinois Pension Code, which
7 benefit is based in whole or in part upon service with the Toll
8 Highway Authority, the Authority shall annually contribute a
9 pro rata share of the State's cost for the benefits of that
10 person.

12     Section 10. The State Finance Act is amended by adding
13 Sections 5.710 and 8.46 as follows:
 
14     (30 ILCS 105/5.710 new)
15     Sec. 5.710. The FY09 Budget Relief Fund.
 
16     (30 ILCS 105/8.46 new)
17     Sec. 8.46. Transfers to the FY09 Budget Relief Fund.
18     (a) The FY09 Budget Relief Fund is created as a special
19 fund in the State Treasury. Amounts may be expended from the
20 Fund only pursuant to specific authorization by appropriation.
21     (b) Notwithstanding any other State law to the contrary,
22 the State Treasurer and State Comptroller are directed to
23 transfer to the FY09 Budget Relief Fund the following amounts

1 from the funds specified, in equal quarterly installments with
2 the first made on the effective date of this amendatory Act of
3 the 95th General Assembly, or as soon thereafter as practical,
4 and with the remaining transfers to be made on October 1, 2008,
5 January 1, 2009, and April 1, 2009, or as soon thereafter as
6 practical:

3     (c) On and after the effective date of this amendatory Act
4 of the 95th General Assembly through June 30, 2009, when any of
5 the funds listed in subsection (b) have insufficient cash from
6 which the State Comptroller may make expenditures properly
7 supported by appropriations from the fund, then the State
8 Treasurer and State Comptroller shall transfer from the FY09
9 Budget Relief Fund to the fund only such amount as is
10 immediately necessary to satisfy outstanding expenditure
11 obligations on a timely basis, subject to the provisions of the
12 State Prompt Payment Act. All or a portion of the amounts
13 transferred from the FY09 Budget Relief Fund to a fund pursuant
14 to this subsection (c) from time to time may be re-transferred
15 by the State Comptroller and the State Treasurer from the
16 receiving fund into the FY09 Budget Relief Fund as soon as and
17 to the extent that deposits are made into or receipts are
18 collected by the receiving fund.
 
19     Section 99. Effective date. This Act takes effect upon
20 becoming law.".
