AMENDMENT TO SENATE BILL 767

2     AMENDMENT NO. ______. Amend Senate Bill 767 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Illinois Procurement Code is amended by
5 changing the heading of Article 15 and Section 15-25 and by
6 adding Section 15-30 as follows:

10     (30 ILCS 500/15-25)
11     Sec. 15-25. Bulletin content.
12     (a) Invitations for bids. Notice of each and every contract
13 that is offered, including renegotiated contracts and change
14 orders, shall be published in the Bulletin. The applicable
15 chief procurement officer may provide by rule an organized

1 format for the publication of this information, but in any case
2 it must include at least the date first offered, the date
3 submission of offers is due, the location that offers are to be
4 submitted to, the purchasing State agency, the responsible
5 State purchasing officer, a brief purchase description, the
6 method of source selection, information of how to obtain a
7 comprehensive purchase description and any disclosure and
8 contract forms, and encouragement to prospective vendors to
9 hire qualified veterans, as defined by Section 45-67 of this
10 Code, and Illinois residents discharged from any Illinois adult
11 correctional center.
12     (b) Contracts let or awarded. Notice of each and every
13 contract that is let or awarded, including renegotiated
14 contracts and change orders, shall be published in the next
15 available subsequent Bulletin, and the applicable chief
16 procurement officer may provide by rule an organized format for
17 the publication of this information, but in any case it must
18 include at least all of the information specified in subsection
19 (a) as well as the name of the successful responsible bidder or
20 offeror, the contract price, the number of unsuccessful
21 responsive bidders, and any other disclosure specified in any
22 Section of this Code. This notice must be posted in the online
23 electronic Bulletin prior to execution of the contract.
24     (c) Emergency purchase disclosure. Any chief procurement
25 officer, State purchasing officer, or designee exercising
26 emergency purchase authority under this Code shall publish a

1 written description and reasons and the total cost, if known,
2 or an estimate if unknown and the name of the responsible chief
3 procurement officer and State purchasing officer, and the
4 business or person contracted with for all emergency purchases
5 in the next timely, practicable Bulletin. This notice must be
6 posted in the online electronic Bulletin within 3 business days
7 after the execution of the contract.
8     (d) Other required disclosure. The applicable chief
9 procurement officer shall provide by rule for the organized
10 publication of all other disclosure required in other Sections
11 of this Code in a timely manner.

14     Sec. 15-30. Electronic Bulletin clearinghouse.
15     (a) The Procurement Policy Board shall maintain on its
16 official website a searchable database containing all
17 information required to be included in the Illinois Procurement
18 Bulletin under subsections (b) and (c) of Section 15-25. The
19 posting of procurement information on the website is subject to
20 the same posting requirements as the online electronic
21 Bulletin.
22     (b) For the purposes of this Section, searchable means
23 searchable and sortable by successful responsible bidder or
24 offeror or, for emergency purchases, business or person
25 contracted with; the contract price or total cost; the service

1 or good; the purchasing State agency; and the date first
2 offered or announced.
3     (c) The Department of Central Management Services, the
4 Capital Development Board, the Department of Transportation,
5 and the higher education chief procurement officer shall
6 provide the Procurement Policy Board the information and
7 resources necessary, and in a manner, to effectuate the purpose
8 of this Section.".
