AMENDMENT TO SENATE BILL 326

2     AMENDMENT NO. ______. Amend Senate Bill 326, AS AMENDED, by
3 replacing everything after the enacting clause with the
4 following:
 
5     "Section 1. Short title. This Act may be cited as the
6 Textbook Consumer Information Act.
 
7     Section 5. Purpose. It is in the interest of the State of
8 Illinois to reduce financial barriers and thereby increase
9 access to higher education for all capable students. The
10 purpose of this Act is to ensure that students have the timely
11 and complete information that they need in order to make
12 informed decisions when purchasing textbooks and other
13 required or suggested materials to further their higher
14 education goals.
 
15     Section 10. Definitions. In this Act:

1     "Institution" means a public institution of higher
2 education that is included in the definition of "public
3 institutions of higher education" under the Board of Higher
4 Education Act.
5     "Off-campus college bookstore" means a bookstore that is
6 not operated by or on behalf of the public institution of
7 higher education, but sells or offers to sell textbooks and
8 supplemental materials to students and has a physical presence
9 on or near the institution's campus.
10     "On-campus college bookstore" means a bookstore, whether
11 operated by or on behalf of the public institution of higher
12 education, that sells or offers to sell textbooks and
13 supplemental materials to students of the public institution of
14 higher education and that has a physical presence on or near
15 the institution's campus.
 
16     Section 15. Requirements of textbook publishers. When
17 contacting prospective clients, each publisher of college
18 textbooks shall disclose the following to the faculty member
19 or, where applicable, the other entity in charge of selecting
20 textbooks for courses taught at an institution:
21         (1) the price at which the publisher would make the
22     textbooks and, if applicable, supplementary learning
23     materials available to the on-campus college bookstore;
24     and
25         (2) the history of revisions for textbooks, if any. If

1     supplemental items are available, the publisher's
2     disclosure must include the supplements' prices if sold
3     individually versus their prices if sold packaged with a
4     textbook (i.e., bundled), where bundling is available.
 
5     Section 20. Requirements of faculty. Any faculty member or
6 entity in charge of selecting textbooks and supplemental
7 materials for courses taught at an institution shall clearly
8 identify to the on-campus college bookstore all textbooks and
9 supplemental materials required and recommended for use for
10 each course and the earliest edition of any required textbook
11 that may be purchased by a student for that course in a manner
12 consistent with the adoption process established by the
13 on-campus college bookstore. Nothing in this Act is intended to
14 alter, impair, or revise the current process by which
15 off-campus college bookstores obtain the identity of textbooks
16 and supplemental materials that have been required or
17 recommended for use for each course in a timely manner.
 
18     Section 25. Requirements of bookstores. The on-campus and
19 off-campus college bookstore, if any, must, with reasonable
20 expediency after the information becomes available, disclose
21 on a per course basis all textbooks and supplementary learning
22 materials that are required for courses taught during each
23 term. The disclosure shall include the title, author, and
24 International Standard Book Number (ISBN) for each textbook and

1 the new and used retail prices, so long as disclosure of the
2 International Standard Book Number (ISBN) does not conflict
3 with or impair the contractual rights of a private third party
4 that operates the on-campus college bookstore on behalf of the
5 institution.
 
6     Section 30. Requirements of institutions. An institution
7 with a textbook rental program is excluded from the
8 requirements of this Act, except that the institution must
9 comply with this Section with respect to those textbook and
10 supplementary course materials not included in the textbook
11 rental program. An institution must publish on the
12 institution's Internet website or at other appropriate venues
13 the title, author, International Standard Book Number (ISBN),
14 and retail price of new and used textbooks within reasonable
15 expediency after the information becomes available.
 
16     Section 99. Effective date. This Act takes effect upon
17 becoming law.".
