AMENDMENT TO SENATE BILL 326

2     AMENDMENT NO. ______. Amend Senate Bill 326 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 1. Short title. This Act may be cited as the
5 Textbook Consumer Information Act.
 
6     Section 5. Purpose. It is in the interest of the State of
7 Illinois to reduce financial barriers and thereby increase
8 access to higher education for all capable students. The
9 purpose of this Act is to ensure that students have the timely
10 and complete information that they need in order to make
11 informed decisions when purchasing textbooks and other
12 required or suggested materials to further their higher
13 education goals.
 
14     Section 10. Definitions. In this Act:
15     "College bookstore" means a bookstore that offers

1 textbooks and supplementary learning materials to students of
2 an institution and that has a physical presence on or near the
3 institution's campus.
4     "Institution" means a public institution of higher
5 education that is included in the definition of "public
6 institutions of higher education" under the Board of Higher
7 Education Act.
 
8     Section 15. Requirements of textbook publishers. When
9 contacting prospective clients, each publisher of college
10 textbooks shall disclose the following to the faculty member
11 or, where applicable, the other entity in charge of selecting
12 textbooks for courses taught at an institution:
13         (1) the price at which the publisher would make the
14     textbooks and, if applicable, supplementary learning
15     materials available to a college bookstore or bookstores;
16     and
17         (2) the history of revisions for such products, if any.
18     If supplemental items are available, the publisher's
19     disclosure must include the supplements' prices if sold
20     individually versus their prices if sold packaged with a
21     textbook (i.e., bundled), where bundling is available.
 
22     Section 20. Requirements of faculty. Any faculty member or
23 entity in charge of selecting textbooks for courses taught at
24 an institution must provide a written statement to the college

1 bookstore or bookstores placing an order for textbooks,
2 detailing all textbooks and supplementary learning materials
3 required for each course, all textbooks and supplementary
4 learning materials suggested for each course, and the earliest
5 edition of any required textbook that may be purchased by a
6 student for that course.
7     Nothing in this Act shall prohibit a faculty member from
8 requiring the most recent edition of a textbook.
 
9     Section 25. Requirements of bookstores. All college
10 bookstores must make available, with reasonable expediency
11 after the information becomes available, a listing of all
12 textbooks and supplementary learning materials that are
13 required for courses taught during each term. The list shall
14 include the title, author, and International Standard Book
15 Number (ISBN) for each textbook and the new and used textbook
16 retail prices.
 
17     Section 30. Requirements of institutions. An institution
18 with a textbook rental program is excluded from the
19 requirements of this Section, except that the institution must
20 comply with this Section with respect those textbook and
21 supplementary course materials not included in the textbook
22 rental program. An institution must publish on the
23 institution's Internet website or at other appropriate venues
24 the title, author, International Standard Book Number (ISBN),

1 and retail price of new and used textbooks within reasonable
2 expediency after the information becomes available, and the
3 institution must ensure the availability of information
4 regarding how current editions of textbooks differ from
5 previous editions.
 
6     Section 99. Effective date. This Act takes effect upon
7 becoming law.".
