1     AN ACT concerning local government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Airport Authorities Act is amended by
5 changing Section 3 and by adding Section 2.7.1 as follows:
 
6     (70 ILCS 5/2.7.1 new)
7     Sec. 2.7.1. Greater Metropolitan Airport Authority.
8     (a) The Greater Metropolitan Airport Authority is hereby
9 established, the territory of which shall include all of the
10 territory within the corporate limits of Peoria County. Within
11 30 days after the initial appointments have been made under
12 subsection (c) of this Section, the Authority board shall
13 notify the office of the Secretary of State of the
14 establishment of the Greater Metropolitan Airport Authority,
15 and the Secretary of State shall issue a certificate of
16 incorporation to the Authority. Upon the issuance of a
17 certificate of incorporation, the Greater Metropolitan Airport
18 Authority shall be deemed an organized airport authority under
19 this Act.
20     (b) If all of the airport facilities of an existing Airport
21 Authority are situated within Peoria County on the effective
22 date of this amendatory Act of the 95th General Assembly, that
23 existing Airport Authority shall be dissolved upon the

1 establishment of the Greater Metropolitan Airport Authority.
2 In such event, the rights to all property, assets, and
3 liabilities, including bonded indebtedness, of the existing
4 Airport Authority shall be assumed by the Greater Metropolitan
5 Airport Authority.
6     (c) The Board of Commissioners of the Greater Metropolitan
7 Airport Authority shall consist of 9 commissioners who shall
8 reside within its corporate limits, and who shall be appointed
9 as follows:
10         (1) The Board of Commissioners of an existing Airport
11     Authority referenced in subsection (b) of this Section
12     shall, upon the establishment of the Greater Metropolitan
13     Airport Authority, be reappointed by their respective
14     appointing authorities to serve their remaining terms of
15     office. Successor appointments to the existing board
16     members shall be made by the original appointing authority.
17         (2) Within 20 days after the effective date of this
18     amendatory Act of the 95th General Assembly, one additional
19     commissioner shall be appointed by each mayor, with the
20     advice and consent of the governing body, of a municipality
21     located wholly within the territory of the Greater
22     Metropolitan Airport Authority that has a population of
23     more than 5,000. No appointment shall be made under this
24     subpart by an appointing authority who is entitled to make
25     an appointment under subpart (1) of this subsection.
26         (3) The members of the General Assembly whose

1     legislative districts encompass any part of the Greater
2     Metropolitan Airport Authority shall appoint any
3     additional commissioners necessary to create a Board of
4     Commissioners consisting of 9 commissioners.
5         (4) Of the commissioners appointed under subparts (2)
6     and (3) of this subsection, one commissioner shall be
7     appointed for a 3-year term, one commissioner shall be
8     appointed for a 4-year term, and one commissioner shall be
9     appointed for a 5-year term. Initial terms shall be
10     determined by lot. Any successor to a commissioner
11     appointed under subpart (2) or (3) of this subsection shall
12     be appointed for a 5-year term.

14     Sec. 3. Boards of commissioners. Every authority
15 established under this Act shall be governed by a board of
16 commissioners. For authorities other than Metropolitan Airport
17 Authorities and the Greater Metropolitan Airport Authority, in
18 the order finding the results of the election to be favorable
19 to the establishment of the authority, the circuit court shall
20 determine the population of the authority and the population of
21 each municipality within the authority having 5,000 or more
22 inhabitants according to the last census.
