SYNOPSIS AS INTRODUCED:

    Amends the Liquefied Petroleum Gas Container Act. Prohibits an owner of a liquefied petroleum gas container from using the restrictions of the Act for the purposes of retaining customers. Effective immediately.

1     AN ACT concerning public safety.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Liquefied Petroleum Gas Container Act is
5 amended by changing Sections 3 and 4 as follows:
 
6     (430 ILCS 10/3)  (from Ch. 96 1/2, par. 5703)
7     Sec. 3. If a liquefied petroleum gas container shall bear
8 upon the surface thereof in plainly legible characters the
9 name, mark, initials or other identifying device of the owner
10 thereof, it shall be unlawful for any person except such owner
11 or a person authorized in writing by him: (a) To fill such
12 container with, or withdraw from such container, liquefied
13 petroleum gas or any other gas or compound; (b) to buy, sell,
14 offer for sale, give, take, loan, deliver or permit to be
15 delivered, or otherwise use, dispose of, or traffic in any such
16 container; or (c) to deface, erase, obliterate, cover up or
17 otherwise remove or conceal or change any such name, mark,
18 initials or other identifying device of the owner or to place
19 the name, mark, initials or other identifying device of any
20 person other than the owner on such container.
21     The restrictions in this Section shall not be used by an
22 owner of a liquefied petroleum gas container for the purposes
23 of retaining customers.

3     Sec. 4. The use of a liquefied petroleum gas container or
4 containers by any person other than the person whose name,
5 mark, initial or device shall be or shall have been upon such
6 liquefied petroleum gas container or containers, without
7 written consent or purchase of such marked and distinguished
8 liquefied petroleum gas container, for the sale of liquefied
9 petroleum gas, filling with liquefied petroleum gas, or the
10 withdrawal of liquefied petroleum gas, or the possession of
11 such liquefied petroleum gas containers by any person other
12 than the person having his name, mark, initial or other device
13 thereon, without the written consent of such owner, shall and
14 is hereby declared to be presumptive evidence of the unlawful
15 use, filling or refilling, transition of, or trafficking in of
16 such liquefied petroleum gas containers.
17     The restrictions in this Section shall not be used by an
18 owner of a liquefied petroleum gas container for the purposes
19 of retaining customers.

21     Section 99. Effective date. This Act takes effect upon
22 becoming law.
