2 | AMENDMENT NO. ______. Amend House Bill 5489 by deleting | ||||||
3 | line 24 on page 8 through line 1 on page 9; and | ||||||
4 | on page 31, by replacing lines 16 through 19 with the | ||||||
5 | following:

6 | "(215 ILCS 5/1600 new)
| ||||||
7 | Sec. 1600. Rules.
Notwithstanding any other rulemaking | ||||||
8 | authority that may exist, neither the Governor nor any agency | ||||||
9 | or agency head under the jurisdiction of the Governor has any | ||||||
10 | authority to make or promulgate rules to implement or enforce | ||||||
11 | the provisions of this Article. If, however, the Governor | ||||||
12 | believes that rules are necessary to implement or enforce the | ||||||
13 | provisions of this Article, the Governor may suggest rules to | ||||||
14 | the General Assembly by filing them with the Clerk of the House | ||||||
15 | and Secretary of the Senate and by requesting that the General | ||||||
16 | Assembly authorize such rulemaking by law, enact those |

1 | suggested rules into law, or take any other appropriate action | ||||||
2 | in the General Assembly's discretion. Nothing contained in this | ||||||
3 | Article shall be interpreted to grant rulemaking authority | ||||||
4 | under any other Illinois statute where such authority is not | ||||||
5 | otherwise explicitly given. For the purposes of this Article, | ||||||
6 | "rules" is given the meaning contained in Section 1-70 of the | ||||||
7 | Illinois Administrative Procedure Act, and "agency" and | ||||||
8 | "agency head" are given the meanings contained in Sections 1-20 | ||||||
9 | and 1-25 of the Illinois Administrative Procedure Act to the | ||||||
10 | extent that such definitions apply to agencies or agency heads | ||||||
11 | under the jurisdiction of the Governor. ".
