2 | AMENDMENT NO. ______. Amend House Bill 4841 by replacing | ||||||
3 | lines 5 through 16 with the following:

4 | "Section 16-23 as follows: | ||||||
5 | (720 ILCS 5/16-23 new) | ||||||
6 | Sec. 16-23. Metal theft. | ||||||
7 | (a) A person commits metal theft when, without the consent | ||||||
8 | of the owner, he or she knowingly obtains or exerts control | ||||||
9 | over property of the owner or aids or assists in obtaining or | ||||||
10 | exerting control over property of the owner consisting of any | ||||||
11 | ferrous or non-ferrous metal, including, but not limited to, | ||||||
12 | any copper or copper alloy, any telegraph, telephone, cable | ||||||
13 | telecommunications, or electric power transmission pedestal or | ||||||
14 | pole, or any telephone, cable telecommunications, or electric | ||||||
15 | power line, wire or fiber insulator, power supply, transformer, | ||||||
16 | transmission or other apparatus, equipment or fixture used in | ||||||
17 | the transmission of telegraph, telephone, cable |

1 | telecommunications, or electrical power service or any | ||||||
2 | equipment related to wireless communications regulated by the | ||||||
3 | Federal Communications Commission. | ||||||
4 | (b) Sentence. Metal theft is a Class 4 felony for a first | ||||||
5 | offense and a Class 3 felony for a second or subsequent | ||||||
6 | offense. ".
