1 | AMENDMENT TO HOUSE BILL 4726

2 | AMENDMENT NO. ______. Amend House Bill 4726 by replacing | ||||||
3 | everything after the enacting clause with the following:
| ||||||
4 | "Section 5. The State Officials and Employees Ethics Act is | ||||||
5 | amended by adding Section 5-60 as follows: | ||||||
6 | (5 ILCS 430/5-60 new) | ||||||
7 | Sec. 5-60. Administrative leave during pending criminal | ||||||
8 | matter. | ||||||
9 | (a) If any officer or government employee is placed on | ||||||
10 | administrative leave, either voluntarily or involuntarily, | ||||||
11 | pending the outcome of a criminal investigation or prosecution | ||||||
12 | and that officer or government employee is removed from office | ||||||
13 | or employment due to his or her resultant criminal conviction, | ||||||
14 | then the officer or government employee is indebted to the | ||||||
15 | State for all compensation and the value of all benefits | ||||||
16 | received during the administrative leave and must forthwith pay |

1 | the full amount to the State. | ||||||
2 | (b) As a matter of law and without the necessity of the | ||||||
3 | adoption of an ordinance or resolution under Section 70-5, if | ||||||
4 | any officer or government employee of a governmental entity is | ||||||
5 | placed on administrative leave, either voluntarily or | ||||||
6 | involuntarily, pending the outcome of a criminal investigation | ||||||
7 | or prosecution and that officer or government employee is | ||||||
8 | removed from office or employment due to his or her resultant | ||||||
9 | criminal conviction, then the officer or government employee is | ||||||
10 | indebted to the governmental entity for all compensation and | ||||||
11 | the value of all benefits received during the administrative | ||||||
12 | leave and must forthwith pay the full amount to the | ||||||
13 | governmental entity.

14 | Section 99. Effective date. This Act takes effect upon | ||||||
15 | becoming law.".
