Amends the Consumer Fraud and Deceptive Business Practices Act. Requires wireless carriers to create and offer consumers an option to opt out of all text message services on wireless service agreements. Requires that the option be available to the customer throughout the length of the contract. Provides that, if the customer elects this option in the middle of an existing contract, the carrier may not adjust the length of the contract. Provides that a violation is an unlawful practice within the meaning of the Act.

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Consumer Fraud and Deceptive Business |
5 |
| Practices Act is amended by adding Section 2BBB as follows: |

| (815 ILCS 505/2BBB new) |

| Sec. 2BBB. Wireless carriers; consumer option to opt out of |
8 |
| text messaging services. A wireless carrier must create and |
9 |
| offer consumers an option to opt out of all text message |
10 |
| services on wireless service agreements. The option must be |
11 |
| available to the customer throughout the length of the |
12 |
| contract. If the customer elects this option in the middle of |
13 |
| an existing contract, the carrier may not adjust the length of |
14 |
| the contract. Any person who violates this Section commits an |
15 |
| unlawful practice within the meaning of this Act.
