Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that a person who sells motor fuel at retail to a consumer by means of a transaction in which the consumer enters a credit card or debit card into a card reader that is located in or near the motor fuel dispensing device must release, at the time the transaction is complete, the amount of any preauthorization hold that is in excess of the amount of the transaction, and that a violation constitutes an unlawful practice under the Act.

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Consumer Fraud and Deceptive Business |
5 |
| Practices Act is amended by adding Section 2BBB as follows: |

| (815 ILCS 505/2BBB new) |
7 |
| Sec. 2BBB. Motor fuel sales; preauthorization hold. |

| (a) As used in this Section: |
9 |
| "Credit card" means that term as it is defined in Section |
10 |
| 2.03 of the Illinois Credit Card and Debit Card Act. |
11 |
| "Debit card" means that term as it is defined in Section |
12 |
| 2.15 of the Illinois Credit Card and Debit Card Act. |

| (b) A person who sells motor fuel at retail to a consumer |
14 |
| by means of a transaction in which the consumer enters a credit |
15 |
| card or debit card into a card reader that is located in or |
16 |
| near the motor fuel dispensing device must release, at the time |
17 |
| the transaction is complete, the amount of any preauthorization |
18 |
| hold that is in excess of the amount of the transaction. |
19 |
| (c) Violation of this Section constitutes an unlawful |
20 |
| practice within the meaning of this Act.
