AMENDMENT TO HOUSE BILL 4470

2     AMENDMENT NO. ______. Amend House Bill 4470 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Department of Commerce and Economic
5 Opportunity Law of the Civil Administrative Code of Illinois is
6 amended by changing Section 605-800 as follows:
 
7     (20 ILCS 605/605-800)  (was 20 ILCS 605/46.19a in part)
8     Sec. 605-800. Training grants for skills in critical
9 demand.
10     (a) Grants to provide training in fields affected by
11 critical demands for certain skills may be made as provided in
12 this Section.
13     (b) The Director may make grants to eligible employers or
14 to other eligible entities on behalf of employers as authorized
15 in subsection (c) to provide training for employees in fields
16 for which there are critical demands for certain skills. No

1 participating employee may be an unauthorized alien, as defined
2 in 8 U.S.C. 1324a.
3     (c) The Director may accept applications for training grant
4 funds and grant requests from: (i) entities sponsoring
5 multi-company eligible employee training projects as defined
6 in subsection (d), including business associations, strategic
7 business partnerships, institutions of secondary or higher
8 education, large manufacturers for supplier network companies,
9 federal Job Training Partnership Act administrative entities
10 or grant recipients, and labor organizations when those
11 projects will address common training needs identified by
12 participating companies; and (ii) individual employers that
13 are undertaking eligible employee training projects as defined
14 in subsection (d), including intermediaries and training
15 agents.
16     (d) The Director may make grants to eligible applicants as
17 defined in subsection (c) for employee training projects that
18 include, but need not be limited to, one or more of the
19 following:
20         (1) Training programs in response to new or changing
21     technology being introduced in the workplace.
22         (2) Job-linked training that offers special skills for
23     career advancement or that is preparatory for, and leads
24     directly to, jobs with definite career potential and
25     long-term job security.
26         (3) Training necessary to implement total quality

1     management or improvement or both management and
2     improvement systems within the workplace.
3         (4) Training related to new machinery or equipment.
4         (5) Training of employees of companies that are
5     expanding into new markets or expanding exports from
6     Illinois.
7         (6) Basic, remedial, or both basic and remedial
8     training of employees as a prerequisite for other
9     vocational or technical skills training or as a condition
10     for sustained employment.
11         (7) Self-employment training of the unemployed and
12     underemployed with comprehensive, competency-based
13     instructional programs and services, entrepreneurial
14     education and training initiatives for youth and adult
15     learners in cooperation with the Illinois Institute for
16     Entrepreneurial Education, training and education,
17     conferences, workshops, and best practice information for
18     local program operators of entrepreneurial education and
19     self-employment training programs.
20         (8) Other training activities or projects, or both
21     training activities and projects, related to the support,
22     development, or evaluation of job training programs,
23     activities, and delivery systems, including training needs
24     assessment and design.
25     (e) Grants shall be made on the terms and conditions that
26 the Department shall determine. No grant made under subsection

1 (d), however, shall exceed 50% of the direct costs of all
2 approved training programs provided by the employer or the
3 employer's training agent or other entity as defined in
4 subsection (c). Under this Section, allowable costs include,
5 but are not limited to:
6         (1) Administrative costs of tracking, documenting,
7     reporting, and processing training funds or project costs.
8         (2) Curriculum development.
9         (3) Wages and fringe benefits of employees.
10         (4) Training materials, including scrap product costs.
11         (5) Trainee travel expenses.
12         (6) Instructor costs, including wages, fringe
13     benefits, tuition, and travel expenses.
14         (7) Rent, purchase, or lease of training equipment.
15         (8) Other usual and customary training costs.
16     (f) The Department may conduct Director will ensure that a
17 minimum of one on-site grant monitoring visits to visit is
18 conducted by the Department either during the course of the
19 grant period or within 6 months following the end of the grant
20 period. The Department shall verify trainee employment dates
21 and wages and to ensure that the grantee's financial management
22 system is structured to provide for accurate, current, and
23 complete disclosure of the financial results of the grant
24 program in accordance with all provisions, terms, and
25 conditions contained in the grant contract. Each applicant
26 must, on request by the Department, provide to the Department a

1 notarized certification signed and dated by a duly authorized
2 representative of the applicant, or that representative's
3 authorized designee, certifying that all participating
4 employees are employed at an Illinois facility and, for each
5 participating employee, stating the employee's name and
6 providing either (i) the employee's social security number or
7 (ii) a statement that the applicant has adequate written
8 verification that the employee is employed at an Illinois
9 facility. The Department may audit the accuracy of submissions.
10 Applicants sponsoring multi-company training grant programs
11 shall obtain information meeting the requirement of this
12 subsection from each participating company and provide it to
13 the Department upon request.
14     (g) The Director may establish and collect a schedule of
15 charges from subgrantee entities and other system users under
16 federal job-training programs for participating in and
17 utilizing the Department's automated job-training program
18 information systems if the systems and the necessary
19 participation and utilization are requirements of the federal
20 job-training programs. All monies collected pursuant to this
21 subsection shall be deposited into the Title III Social
22 Security and Employment Fund, except that any moneys that may
23 be necessary to pay liabilities outstanding as of June 30, 2000
24 shall be deposited into the Federal Job-Training Information
25 Systems Revolving Fund.
