1 | AMENDMENT TO HOUSE BILL 4131

2 | AMENDMENT NO. ______. Amend House Bill 4131 by replacing | ||||||
3 | the title with the following:

4 | "AN ACT concerning transportation, which may be referred to | ||||||
5 | as Shib's Law."; and | ||||||
6 | by replacing everything after the enacting clause with the | ||||||
7 | following: | ||||||
8 | "Section 5. The Illinois Vehicle Code is amended by adding | ||||||
9 | Section 11-213 as follows: | ||||||
10 | (625 ILCS 5/11-213 new) | ||||||
11 | Sec. 11-213. Power of a fire department officer; highway or | ||||||
12 | lane closure. In the absence of a law enforcement officer or a | ||||||
13 | representative of the highway agency having jurisdiction over | ||||||
14 | the highway, an officer of a fire department, in the
| ||||||
15 | performance of his or her official duties, has the authority to

1 | close to traffic a highway, or a lane or lanes of a highway, as
| ||||||
2 | necessary to protect the safety of persons or property. In | ||||||
3 | order to promote the safe implementation of this Section, the | ||||||
4 | fire department officer shall utilize an official fire | ||||||
5 | department vehicle with lighted red or white oscillating, | ||||||
6 | rotating, or flashing lights in accordance with subsection | ||||||
7 | (a)(2-4) of Section 12-215 of this Code and proper temporary | ||||||
8 | traffic control in accordance with the sections of the Illinois | ||||||
9 | Manual on Uniform Traffic Control Devices concerning temporary | ||||||
10 | traffic control and incident management. The officer should | ||||||
11 | also receive training in safe practices for accomplishing these | ||||||
12 | tasks near traffic. This Section shall not apply to highways | ||||||
13 | under the jurisdiction of the Illinois State Toll Highway | ||||||
14 | Authority.
The term "highway" shall have the meaning defined by | ||||||
15 | Section 1-126 of this Code. ".
