2 | AMENDMENT NO. ______. Amend House Bill 3742 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "ARTICLE 1. SHORT TITLE; PURPOSE | ||||||
5 | Section 1-1. Short title. This Act may be cited as the | ||||||
6 | FY2009 Budget Implementation (Finance) Act. | ||||||
7 | Section 1-5. Purpose. It is the purpose of this Act to make | ||||||
8 | changes in State programs that are necessary to implement the | ||||||
9 | Governor's Fiscal Year 2009 budget recommendations concerning | ||||||
10 | finance. | ||||||
11 | ARTICLE 5. AMENDATORY PROVISIONS | ||||||
12 | Section 5-20. The State Finance Act is amended by changing | ||||||
13 | Sections 6z-63, 6z-64, and 13.2 as follows: |

1 | (30 ILCS 105/6z-63)
| ||||||
2 | Sec. 6z-63. The Professional Services Fund. | ||||||
3 | (a) The Professional Services Fund is created as a | ||||||
4 | revolving fund in the State treasury. The following moneys | ||||||
5 | shall be deposited into the Fund: | ||||||
6 | (1) amounts authorized for transfer to the Fund from | ||||||
7 | the General Revenue Fund and other State funds (except for | ||||||
8 | funds classified by the Comptroller as federal trust funds | ||||||
9 | or State trust funds) pursuant to State law or Executive | ||||||
10 | Order; | ||||||
11 | (2) federal funds received by the Department of Central | ||||||
12 | Management Services (the "Department") as a result of | ||||||
13 | expenditures from the Fund; | ||||||
14 | (3) interest earned on moneys in the Fund; and | ||||||
15 | (4) receipts or inter-fund transfers resulting from | ||||||
16 | billings issued by the Department to State agencies for the | ||||||
17 | cost of professional services rendered by the Department | ||||||
18 | that are not compensated through the specific fund | ||||||
19 | transfers authorized by this Section. | ||||||
20 | (b) Moneys in the Fund may be used by the Department for | ||||||
21 | reimbursement or payment for: | ||||||
22 | (1) providing professional services to State agencies | ||||||
23 | or other State entities; | ||||||
24 | (2) rendering other services to State agencies at the | ||||||
25 | Governor's direction or to other State entities upon |

| |||||||
1 | agreement between the Director of Central Management | ||||||
2 | Services and the appropriate official or governing body of | ||||||
3 | the other State entity; or | ||||||
4 | (3) providing for payment of administrative and other | ||||||
5 | expenses incurred by the Department in providing | ||||||
6 | professional services. | ||||||
7 | (c) State agencies or other State entities may direct the | ||||||
8 | Comptroller to process inter-fund
transfers or make payment | ||||||
9 | through the voucher and warrant process to the Professional | ||||||
10 | Services Fund in satisfaction of billings issued under | ||||||
11 | subsection (a) of this Section. | ||||||
12 | (d) Reconciliation. For the fiscal year beginning on July | ||||||
13 | 1, 2004 only, the Director of Central Management Services (the | ||||||
14 | "Director") shall order that each State agency's payments and | ||||||
15 | transfers made to the Fund be reconciled with actual Fund costs | ||||||
16 | for professional services provided by the Department on no less | ||||||
17 | than an annual basis. The Director may require reports from | ||||||
18 | State agencies as deemed necessary to perform this | ||||||
19 | reconciliation. | ||||||
20 | (e) The following amounts are authorized for transfer into | ||||||
21 | the
Professional Services Fund for the fiscal year beginning | ||||||
22 | July 1, 2004: | ||||||

24 | (e-5) Notwithstanding any other provision of State law to | ||||||
25 | the contrary, on or after July 1, 2005 and through June 30, | ||||||
26 | 2006, in addition to any other transfers that may be provided |

| |||||||
1 | for by law, at the direction of and upon notification from the | ||||||
2 | Director of Central Management Services, the State Comptroller | ||||||
3 | shall direct and the State Treasurer shall transfer amounts | ||||||

22 | Sec. 6z-64. The Workers' Compensation Revolving Fund. | ||||||
23 | (a) The Workers' Compensation Revolving Fund is created as | ||||||
24 | a revolving fund in the State treasury. The following moneys | ||||||
25 | shall be deposited into the Fund: |
| |||||||
| |||||||
1 | (1) amounts authorized for transfer to the Fund from | ||||||
2 | the General Revenue Fund and other State funds (except for | ||||||
3 | funds classified by the Comptroller as federal trust funds | ||||||
4 | or State trust funds) pursuant to State law or Executive | ||||||
5 | Order; | ||||||
6 | (2) federal funds received by the Department of Central | ||||||
7 | Management Services (the "Department") as a result of | ||||||
8 | expenditures from the Fund; | ||||||
9 | (3) interest earned on moneys in the Fund; | ||||||
10 | (4) receipts or inter-fund transfers resulting from | ||||||
11 | billings issued by the Department to State agencies and | ||||||
12 | universities for the cost of workers' compensation | ||||||
13 | services rendered by the Department that are not | ||||||
14 | compensated through the specific fund transfers authorized | ||||||
15 | by this Section, if any; | ||||||
16 | (5) amounts received from a State agency or university | ||||||
17 | for workers' compensation payments for temporary total | ||||||
18 | disability, as provided in Section 405-105 of the | ||||||
19 | Department of Central Management Services Law of the Civil | ||||||
20 | Administrative Code of Illinois; and | ||||||
21 | (6) amounts recovered through subrogation in workers' | ||||||
22 | compensation and workers' occupational disease cases. | ||||||
23 | (b) Moneys in the Fund may be used by the Department for | ||||||
24 | reimbursement or payment for: | ||||||
25 | (1) providing workers' compensation services to State | ||||||
26 | agencies and State universities; or |
| |||||||
| |||||||
1 | (2) providing for payment of administrative and other | ||||||
2 | expenses incurred by the Department in providing workers' | ||||||
3 | compensation services. | ||||||
4 | (c) State agencies may direct the Comptroller to process | ||||||
5 | inter-fund
transfers or make payment through the voucher and | ||||||
6 | warrant process to the Workers' Compensation Revolving Fund in | ||||||
7 | satisfaction of billings issued under subsection (a) of this | ||||||
8 | Section. | ||||||
9 | (d) Reconciliation. For the fiscal year beginning on July | ||||||
10 | 1, 2004 only, the Director of Central Management Services (the | ||||||
11 | "Director") shall order that each State agency's payments and | ||||||
12 | transfers made to the Fund be reconciled with actual Fund costs | ||||||
13 | for workers' compensation services provided by the Department | ||||||
14 | and attributable to the State agency and relevant fund on no | ||||||
15 | less than an annual basis. The Director may require reports | ||||||
16 | from State agencies as deemed necessary to perform this | ||||||
17 | reconciliation. | ||||||
18 | (d-5) Notwithstanding any other provision of State law to | ||||||
19 | the contrary, on or after July 1, 2005 and until June 30, 2006, | ||||||
20 | in addition to any other transfers that may be provided for by | ||||||
21 | law, at the direction of and upon notification of the Director | ||||||
22 | of Central Management Services, the State Comptroller shall | ||||||
23 | direct and the State Treasurer shall transfer amounts into the | ||||||
24 | Workers' Compensation Revolving Fund from the designated funds | ||||||

11 | (a) Transfers among line item appropriations from the same

more such line item appropriations is | ||||||
15 | insufficient for the purpose for
which the appropriation was | ||||||
16 | made.

17 | (a-1) No transfers may be made from one
agency to another | ||||||
18 | agency, nor may transfers be made from one institution
of | ||||||
19 | higher education to another institution of higher education.
| ||||||
20 | (a-2) Except as otherwise provided in this Section, | ||||||
21 | transfers may be made only among the objects of expenditure | ||||||
22 | enumerated
in this Section, except that no funds may be | ||||||
23 | transferred from any
appropriation for personal services, from | ||||||
24 | any appropriation for State
contributions to the State | ||||||
25 | Employees' Retirement System, from any
separate appropriation |

1 | for employee retirement contributions paid by the
employer, nor | ||||||
2 | from any appropriation for State contribution for

3 | group insurance. During State fiscal year 2005, an agency may | ||||||

7 | retirement systems; notwithstanding and in addition to the | ||||||

9 | fiscal year 2005 transfers authorized in this sentence may be | ||||||
10 | made in an amount not to exceed 2% of the aggregate amount | ||||||
11 | appropriated to an agency within the same treasury fund. During | ||||||
12 | State fiscal years year 2007 and 2009 , the Departments of | ||||||
13 | Children and Family Services, Corrections, Human Services, and | ||||||
14 | Juvenile Justice may transfer amounts among their respective | ||||||
15 | appropriations within the same treasury fund for personal | ||||||
16 | services, employee retirement contributions paid by employer, | ||||||
17 | and State contributions to retirement systems. | ||||||
18 | Notwithstanding, and in addition to, the transfers authorized | ||||||
19 | in subsection (c) of this Section, these transfers may be made | ||||||
20 | in an amount not to exceed 2% of the aggregate amount | ||||||
21 | appropriated to an agency within the same treasury fund.
| ||||||
22 | (a-3) Further, if an agency receives a separate
| ||||||
23 | appropriation for employee retirement contributions paid by | ||||||
24 | the employer,
any transfer by that agency into an appropriation | ||||||
25 | for personal services
must be accompanied by a corresponding | ||||||
26 | transfer into the appropriation for
employee retirement |

| |||||||
1 | contributions paid by the employer, in an amount
sufficient to | ||||||
2 | meet the employer share of the employee contributions
required | ||||||
3 | to be remitted to the retirement system.
| ||||||
4 | (b) In addition to the general transfer authority provided | ||||||

subsection (c), the following agencies have the specific | ||||||
6 | transfer authority
granted in this subsection:

7 | The Department of Healthcare and Family Services is | ||||||
8 | authorized to make transfers
representing savings attributable | ||||||
9 | to not increasing grants due to the
births of additional | ||||||
10 | children from line items for payments of cash grants to
line | ||||||
11 | items for payments for employment and social services for the | ||||||
12 | purposes
outlined in subsection (f) of Section 4-2 of the | ||||||
13 | Illinois Public Aid Code.

14 | The Department of Children and Family Services is | ||||||
15 | authorized to make
transfers not exceeding 2% of the aggregate | ||||||
16 | amount appropriated to it within
the same treasury fund for the | ||||||

7 | contrary, for State fiscal year 2003
only, transfers among line | ||||||
8 | item appropriations to an agency from the same
treasury fund | ||||||
9 | may be made provided that the sum of such transfers for an | ||||||
10 | agency
in State fiscal year 2003 shall not exceed 3% of the | ||||||
11 | aggregate amount
appropriated to that State agency for State | ||||||
12 | fiscal year 2003 for the following
objects: personal services, | ||||||
13 | except that no transfer may be approved which
reduces the | ||||||
14 | aggregate appropriations for personal services within an | ||||||
15 | agency;
extra help; student and inmate compensation; State
| ||||||
16 | contributions to retirement systems; State contributions to | ||||||
17 | social security;
State contributions for employee group | ||||||
18 | insurance; contractual services; travel;
commodities; | ||||||
19 | printing; equipment; electronic data processing; operation of
| ||||||
20 | automotive equipment; telecommunications services; travel and | ||||||
21 | allowance for
committed, paroled, and discharged prisoners; | ||||||
22 | library books; federal matching
grants for student loans; | ||||||
23 | refunds; workers' compensation, occupational disease,
and tort | ||||||
24 | claims; and, in appropriations to institutions of higher | ||||||
25 | education,
awards and grants.

26 | (c-2) Special provisions for State fiscal year 2005. |

| |||||||
1 | Notwithstanding subsections (a), (a-2), and (c), for State | ||||||
2 | fiscal year 2005 only, transfers may be made among any line | ||||||
3 | item appropriations from the same or any other treasury fund | ||||||
4 | for any objects or purposes, without limitation, when the | ||||||
5 | balance remaining in one or more such line item appropriations | ||||||
6 | is insufficient for the purpose for which the appropriation was | ||||||
7 | made, provided that the sum of those transfers by a State | ||||||
8 | agency shall not exceed 4% of the aggregate amount appropriated | ||||||
9 | to that State agency for fiscal year 2005.
| ||||||
10 | (d) Transfers among appropriations made to agencies of the | ||||||
11 | Legislative
and Judicial departments and to the | ||||||
12 | constitutionally elected officers in the
Executive branch | ||||||
13 | require the approval of the officer authorized in Section 10
of | ||||||
14 | this Act to approve and certify vouchers. Transfers among | ||||||
15 | appropriations
made to the University of Illinois, Southern | ||||||
16 | Illinois University, Chicago State
University, Eastern | ||||||
17 | Illinois University, Governors State University, Illinois
| ||||||
18 | State University, Northeastern Illinois University, Northern | ||||||
19 | Illinois
University, Western Illinois University, the Illinois | ||||||
20 | Mathematics and Science
Academy and the Board of Higher | ||||||
21 | Education require the approval of the Board of
Higher Education | ||||||
22 | and the Governor. Transfers among appropriations to all other
| ||||||
23 | agencies require the approval of the Governor.
| ||||||
24 | The officer responsible for approval shall certify that the
| ||||||
25 | transfer is necessary to carry out the programs and purposes | ||||||
26 | for which
the appropriations were made by the General Assembly |
| |||||||
| |||||||
1 | and shall transmit
to the State Comptroller a certified copy of | ||||||
2 | the approval which shall
set forth the specific amounts | ||||||
3 | transferred so that the Comptroller may
change his records | ||||||
4 | accordingly. The Comptroller shall furnish the
Governor with | ||||||
5 | information copies of all transfers approved for agencies
of | ||||||
6 | the Legislative and Judicial departments and transfers | ||||||
7 | approved by
the constitutionally elected officials of the | ||||||
8 | Executive branch other
than the Governor, showing the amounts | ||||||
9 | transferred and indicating the
dates such changes were entered | ||||||
10 | on the Comptroller's records.
| ||||||
11 | (e) The State Board of Education, in consultation with the | ||||||
12 | State Comptroller, may transfer line item appropriations for | ||||||
13 | General State Aid from the Common School Fund to the Education | ||||||
14 | Assistance Fund. | ||||||

16 | Section 5-55. The Fire Investigation Act is amended by | ||||||
17 | changing Section 13.1 as follows:
| ||||||
18 | (425 ILCS 25/13.1) (from Ch. 127 1/2, par. 17.1)
| ||||||
19 | Sec. 13.1. (a) There shall be a special fund in the State | ||||||
20 | Treasury
known as the Fire Prevention Fund.
| ||||||
21 | (b) The following moneys shall be deposited into the Fund:
| ||||||
22 | (1) Moneys received by the Department of Insurance | ||||||
23 | under Section 12 of this Act.
| ||||||
24 | (2) All fees and reimbursements received by the Office |
| |||||||
| |||||||
1 | of the State Fire Marshal.
| ||||||
2 | (3) All receipts from boiler and pressure vessel | ||||||
3 | certification, as
provided in Section 13 of the Boiler and | ||||||
4 | Pressure Vessel Safety Act.
| ||||||
5 | (4) Such other moneys as may be provided by law.
| ||||||
6 | (c) The moneys in the Fire Prevention Fund shall be used, | ||||||
7 | subject to
appropriation, for the following purposes:
| ||||||
8 | (1) Of the moneys deposited into the fund under Section | ||||||
9 | 12 of this Act,
12.5% shall be available for the | ||||||
10 | maintenance of the Illinois Fire Service
Institute and the | ||||||
11 | expenses, facilities, and structures incident thereto,
and | ||||||
12 | for making transfers into the General Obligation Bond | ||||||
13 | Retirement and
Interest Fund for debt service requirements | ||||||
14 | on bonds issued by the State of
Illinois after January 1, | ||||||
15 | 1986 for the purpose of constructing a training
facility | ||||||
16 | for use by the Institute.
| ||||||
17 | (2) Of the moneys deposited into the Fund under Section | ||||||
18 | 12 of this Act,
10% shall be available for the maintenance | ||||||
19 | of the Chicago Fire Department
Training Program and the | ||||||
20 | expenses, facilities and structures incident
thereto, in | ||||||
21 | addition to any moneys payable from the Fund to the City of
| ||||||
22 | Chicago pursuant to the Illinois Fire Protection Training | ||||||
23 | Act.
| ||||||
24 | (3) For making payments to local governmental agencies | ||||||
25 | and individuals
pursuant to Section 10 of the Illinois Fire | ||||||
26 | Protection Training Act.

| |||||||
| |||||||
1 | (4) For the maintenance and operation of the Office of | ||||||
2 | the State Fire
Marshal, and the expenses incident thereto.
| ||||||
3 | (5) For the Department of Public Health to develop
and | ||||||
4 | administer Emergency Medical Services testing programs and | ||||||
5 | for other Emergency Medical Services related expenses. | ||||||
6 | (6) (5) For any other purpose authorized by law.
| ||||||
7 | (c-5) As soon as possible after the effective date of this | ||||||
8 | amendatory Act of the 95th General Assembly, the Comptroller | ||||||
9 | shall order the transfer and the Treasurer shall transfer | ||||||
10 | $2,000,000 from the Fire Prevention Fund to the Fire Service | ||||||
11 | and Small Equipment Fund, $9,000,000 from the Fire Prevention | ||||||
12 | Fund to the Fire Truck Revolving Loan Fund, and $4,000,000 from | ||||||
13 | the Fire Prevention Fund to the Ambulance Revolving Loan Fund. | ||||||
14 | Beginning on July 1, 2008, each month, or as soon as practical | ||||||
15 | thereafter, an amount equal to $2 from each fine received shall | ||||||
16 | be transferred from the Fire Prevention Fund to the Fire | ||||||
17 | Service and Small Equipment Fund, an amount equal to $1.50 from | ||||||
18 | each fine received shall be transferred from the Fire | ||||||
19 | Prevention Fund to the Fire Truck Revolving Loan Fund, and an | ||||||
20 | amount equal to $4 from each fine received shall be transferred | ||||||
21 | from the Fire Prevention Fund to the Ambulance Revolving Loan | ||||||
22 | Fund. These moneys shall be transferred from the moneys | ||||||
23 | deposited into the Fire Prevention Fund pursuant to Public Act | ||||||
24 | 95-154, together with any other moneys as may be necessary to | ||||||
25 | carry out this mandate.
| ||||||
26 | (d) Any portion of the Fire Prevention Fund remaining |
| |||||||
| |||||||
1 | unexpended at the
end of any fiscal year which is not needed | ||||||
2 | for the maintenance and expenses of the
Office of the State | ||||||
3 | Fire Marshal or the maintenance and expenses of the
Illinois | ||||||
4 | Fire Service Institute, shall remain in the Fire Prevention | ||||||
5 | Fund for the exclusive and restricted uses provided in | ||||||
6 | subsections
(c) and (c-5) of this Section.
| ||||||
7 | (e) The Office of the State Fire Marshal shall keep on file | ||||||
8 | an itemized
statement of all expenses incurred which are | ||||||
9 | payable from the Fund, other
than expenses incurred by the | ||||||
10 | Illinois Fire Service Institute, and shall
approve all vouchers | ||||||
11 | issued therefor before they are submitted to the State
| ||||||
12 | Comptroller for payment. Such vouchers shall be allowed and | ||||||
13 | paid in the
same manner as other claims against the State.

15 | ARTICLE 15. ALTERNATIVE RETIREMENT CANCELLATION PAYMENT | ||||||
16 | Section 15-5. The Illinois Pension Code is amended by | ||||||
17 | changing Section 14-108.6 as follows: | ||||||
18 | (40 ILCS 5/14-108.6) | ||||||
19 | Sec. 14-108.6. Alternative retirement cancellation | ||||||
20 | payment. | ||||||
21 | (a) To be eligible for the alternative retirement | ||||||
22 | cancellation payment provided in this Section, a person
must: | ||||||
23 | (1) be a member of this System who, as of June 1, 2008 |

1 | 2006 , was
(i) in active payroll status as an employee in a | ||||||
2 | position listed in subsection (b) of this Section
and | ||||||
3 | continuously employed in a position listed in subsection | ||||||
4 | (b) on and after January 1, 2008 2006 and (ii) an active | ||||||
5 | contributor to this System with respect to that employment; | ||||||
6 | (2) have not previously received any retirement | ||||||
7 | annuity under this Article; | ||||||
8 | (3) in the case of persons employed in a position title | ||||||
9 | listed under paragraph (1) of subsection (b), be among the | ||||||
10 | first 500 persons to file with the Board on or before | ||||||
11 | August 31, 2008 2006 a written
application requesting the | ||||||
12 | alternative retirement cancellation payment provided in | ||||||
13 | this Section; | ||||||
14 | (4) in the case of persons employed in a position title | ||||||
15 | listed under paragraph (2) of subsection (b), have received | ||||||
16 | written authorization from the director or other head of | ||||||
17 | his or her department and filed that authorization with the | ||||||
18 | system on or before August 1, 2008 2006 ; | ||||||
19 | (5) if there is a QILDRO in effect against the person, | ||||||
20 | file with the Board the written consent of all alternate | ||||||
21 | payees under the QILDRO to the election of an alternative | ||||||
22 | retirement cancellation payment under this Section;
and | ||||||
23 | (6) terminate employment under this Article within one | ||||||
24 | month after approval of the person's application | ||||||
25 | requesting the alternative retirement cancellation | ||||||
26 | payment, but in no event later than September 30, 2008 |

10 | (2) In addition, any position titles with the Speaker | ||||||
11 | of the House of Representatives, the Minority Leader of the | ||||||
12 | House of Representatives, the President of the Senate, the | ||||||
13 | Minority Leader of the Senate, the Attorney General, the | ||||||
14 | Secretary of State, the Comptroller, the Treasurer, the | ||||||
15 | Auditor General, the Supreme Court, the Court of Claims, | ||||||
16 | and each legislative agency are eligible for the | ||||||
17 | alternative retirement cancellation payment provided in | ||||||
18 | this Section. | ||||||
19 | (c) In lieu of any retirement annuity or other benefit | ||||||
20 | provided under this Article, a person who qualifies for and | ||||||
21 | elects to receive the alternative retirement cancellation | ||||||
22 | payment under this Section shall be entitled to receive a | ||||||
23 | one-time lump sum retirement cancellation payment equal to the | ||||||
24 | amount of his or her contributions to the System (including any | ||||||
25 | employee contributions for optional service credit and | ||||||
26 | including any employee contributions paid by the employer or |
| |||||||
| |||||||
1 | credited to the employee during disability) as of the date of | ||||||
2 | termination, with regular interest, multiplied by 2.
| ||||||
3 | (d) Notwithstanding any other provision of this Article, a | ||||||
4 | person who receives an alternative retirement cancellation | ||||||
5 | payment under this Section thereby forfeits the right to any | ||||||
6 | other retirement or disability benefit or refund under this | ||||||
7 | Article, and no widow's, survivor's, or death benefit deriving | ||||||
8 | from that person shall be payable under this Article. Upon | ||||||
9 | accepting an alternative retirement cancellation payment under | ||||||
10 | this Section, the person's creditable service and all other | ||||||
11 | rights in the System are terminated for all purposes, except | ||||||
12 | for the purpose of determining State group life and health | ||||||
13 | benefits for the person and his or her survivors as provided | ||||||
14 | under the State Employees Group Insurance Act of 1971. | ||||||
15 | (e) To the extent permitted by federal law, a person who | ||||||
16 | receives an alternative retirement cancellation payment under | ||||||
17 | this Section may direct the System to pay all or a portion of | ||||||
18 | that payment as a rollover into another retirement plan or | ||||||
19 | account qualified under the Internal Revenue Code of 1986, as | ||||||
20 | amended. | ||||||
21 | (f) Notwithstanding Section 14-111, a person who has | ||||||
22 | received an alternative retirement cancellation payment under | ||||||
23 | this Section and who reenters
service under this Article other | ||||||
24 | than as a temporary employee must repay to the System the | ||||||
25 | amount by which that alternative retirement cancellation | ||||||
26 | payment exceeded the amount of his or her refundable employee |
| |||||||
| |||||||
1 | contributions within 60 days of resuming employment under this | ||||||
2 | System. For the purposes of re-establishing creditable service | ||||||
3 | that was terminated upon election of the alternative retirement | ||||||
4 | cancellation payment, the portion of the alternative | ||||||
5 | retirement cancellation payment representing refundable | ||||||
6 | employee contributions shall be deemed a refund repayable in | ||||||
7 | accordance with Section 14-130. | ||||||
8 | (g) The Commission on Government Forecasting and | ||||||
9 | Accountability shall determine
and report to the Governor and | ||||||
10 | the General
Assembly, on or before January 1, 2010 2008 , its | ||||||
11 | estimate of (1) the annual amount of payroll savings likely to | ||||||
12 | be
realized by the State as a result of the early termination | ||||||
13 | of persons receiving
the alternative retirement cancellation | ||||||
14 | payment under this Section and (2) the net annual savings
or | ||||||
15 | cost to the State from the program of alternative retirement | ||||||
16 | cancellation payments under this Section. | ||||||
17 | The System, the Department of Central Management Services, | ||||||
18 | the
Governor's Office of Management and Budget, and all other | ||||||
19 | departments shall provide to the Commission any
assistance that | ||||||
20 | the Commission may request with respect to its report under
| ||||||
21 | this Section. The Commission may require departments to provide | ||||||
22 | it with any
information that it deems necessary or useful with | ||||||
23 | respect to its reports under
this Section, including without | ||||||
24 | limitation information about (1) the final
earnings of former | ||||||
25 | department employees who elected to receive alternative | ||||||
26 | retirement cancellation payments under
this Section, (2) the |
| |||||||
| |||||||
1 | earnings of current department employees holding the
positions | ||||||
2 | vacated by persons who elected to receive alternative | ||||||
3 | retirement cancellation payments under this
Section, and (3) | ||||||
4 | positions vacated by persons who elected to receive alternative | ||||||
5 | retirement cancellation payments
under this Section that have | ||||||
6 | not yet been refilled.
