2 | AMENDMENT NO. ______. Amend House Bill 3679 by replacing | ||||||
3 | everything after the enacting clause with the following:
| ||||||
4 | "Section 5. The Medical Practice Act of 1987 is amended by | ||||||
5 | adding Section 54.7 as follows: | ||||||
6 | (225 ILCS 60/54.7 new) | ||||||
7 | Sec. 54.7. Administration of intense pulsed light system. | ||||||
8 | The use of intense pulsed light systems or lasers required to | ||||||
9 | be registered under the Laser System Act of 1997 is considered | ||||||
10 | the practice of medicine. A procedure may not be performed on | ||||||
11 | an individual without an order from a physician licensed to | ||||||
12 | practice medicine in all its branches. A physician licensed to | ||||||
13 | practice medicine in all its branches may delegate the | ||||||
14 | application of an intense pulsed light system or a laser for | ||||||
15 | the purpose of care or treatment to a physician assistant, | ||||||
16 | advanced practice nurse, registered nurse, electrologist, or |

1 | other persons, provided those persons operating the intense | ||||||
2 | pulsed light system or laser have documented training. The | ||||||
3 | Department may establish additional requirements for | ||||||
4 | implementation of this Section by rule. | ||||||
5 | Section 10. The Electrologist Licensing Act is amended by | ||||||
6 | changing Section 23 as follows:

7 | (225 ILCS 412/23)
| ||||||
8 | (Section scheduled to be repealed on January 1, 2014)
| ||||||
9 | Sec. 23. Scope of practice.
| ||||||
10 | (a) The scope of practice of an electrologist is limited to | ||||||
11 | the following:
| ||||||
12 | (1) The application of an antiseptic on the area of the
| ||||||
13 | individual's skin to which electrology will be applied.
| ||||||
14 | (2) The use of a sterile needle/probe electrode type | ||||||
15 | epilation, which
includes (i) electrolysis, known as | ||||||
16 | direct current/DC, (ii) thermolysis, known
as
alternating | ||||||
17 | current/AC, or (iii) a combination of both electrolysis and
| ||||||
18 | thermolysis,
known as superimposed or sequential blend.
| ||||||
19 | (b) Nothing in this Act shall be construed to authorize an | ||||||
20 | electrologist to
use surgery including but not limited to the | ||||||
21 | use of any laser technology , except as provided in Section 54.7 | ||||||
22 | of the Medical Practice Act of 1987 . An
electrologist shall | ||||||
23 | refer to a licensed physician any individual
whose
condition, | ||||||
24 | at the time of evaluation or service, is determined to be

1 | beyond the
scope of practice of the electrologist, such as an | ||||||
2 | individual with signs of
infection or bleeding.

4 | Section 99. Effective date. This Act takes effect upon | ||||||
5 | becoming law.".
