2 | AMENDMENT NO. ______. Amend House Bill 3491 by replacing | ||||||
3 | everything after the enacting clause with the following:
| ||||||
4 | "Section 5. The Critical Health Problems and Comprehensive | ||||||
5 | Health
Education Act is amended by changing Section 3 as | ||||||
6 | follows:
| ||||||
7 | (105 ILCS 110/3) (from Ch. 122, par. 863)
| ||||||
8 | Sec. 3. Comprehensive Health Education Program. The | ||||||
9 | program established
under this Act shall include, but not be | ||||||
10 | limited to, the following major
educational areas as a basis | ||||||
11 | for curricula in all elementary and secondary
schools in this | ||||||
12 | State: human ecology and health, human growth and
development, | ||||||
13 | the emotional, psychological, physiological, hygienic and
| ||||||
14 | social responsibilities of family life, including sexual | ||||||
15 | abstinence until
marriage, prevention and control of disease, | ||||||
16 | including instruction in
grades 6 through 12 on the prevention, |

| |||||||
1 | transmission and spread of AIDS,
public and environmental | ||||||
2 | health, consumer health, safety education and
disaster | ||||||
3 | survival, mental health and illness, personal health habits,
| ||||||
4 | alcohol, drug use, and abuse including the medical and legal | ||||||
5 | ramifications
of alcohol, drug, and tobacco use, abuse during | ||||||
6 | pregnancy, sexual
abstinence until marriage, tobacco, | ||||||
7 | nutrition, and dental health. The program shall also provide | ||||||
8 | course material and instruction to advise pupils of the | ||||||
9 | Abandoned Newborn Infant Protection Act.
Notwithstanding the | ||||||
10 | above educational areas, the following areas may also
be | ||||||
11 | included as a basis for curricula in all elementary and | ||||||
12 | secondary
schools in this State: basic first aid (including, | ||||||
13 | but not limited to,
cardiopulmonary resuscitation and the | ||||||
14 | Heimlich maneuver), early prevention
and detection of cancer, | ||||||
15 | heart disease, diabetes, stroke, and the
prevention of child | ||||||
16 | abuse, neglect, and suicide.
The school board of each
public | ||||||
17 | elementary and secondary school in the State
shall encourage | ||||||
18 | all teachers and other school personnel to acquire,
develop, | ||||||
19 | and maintain the knowledge and skills necessary to properly
| ||||||
20 | administer life-saving techniques, including without | ||||||
21 | limitation the
Heimlich maneuver and rescue breathing , except | ||||||
22 | that the school board shall require all teachers and other | ||||||
23 | school personnel hired on or after the effective date of this | ||||||
24 | amendatory Act of the 95th General Assembly to acquire, | ||||||
25 | develop, and maintain the knowledge and skills necessary to | ||||||
26 | properly administer cardiopulmonary resuscitation .
The |

| |||||||
1 | training shall be in
accordance with standards of the
American | ||||||
2 | Red Cross, the American Heart Association, or another | ||||||
3 | nationally
recognized certifying organization.
A school board | ||||||
4 | may use the
services of non-governmental entities whose | ||||||
5 | personnel have expertise in
life-saving techniques to instruct | ||||||
6 | teachers and other school personnel in
these techniques. Each | ||||||
7 | school board
is encouraged to have in
its employ, or on its | ||||||
8 | volunteer staff, at least one person who is certified, by
the | ||||||
9 | American Red Cross or by another qualified certifying agency,
| ||||||
10 | as qualified to administer first aid and
cardiopulmonary | ||||||
11 | resuscitation. In addition, each school board is authorized to
| ||||||
12 | allocate appropriate portions of its institute or inservice | ||||||
13 | days to conduct
training programs for teachers and other school | ||||||
14 | personnel who have expressed an
interest in becoming qualified | ||||||
15 | to administer emergency first aid or who have expressed an | ||||||
16 | interest in becoming or who are required to become qualified to | ||||||
17 | administer
cardiopulmonary resuscitation. School boards are | ||||||
18 | urged to
encourage their teachers and other school personnel | ||||||
19 | who coach school athletic
programs and other extracurricular | ||||||
20 | school activities to acquire, develop, and
maintain the | ||||||
21 | knowledge and skills necessary to properly administer first aid
| ||||||
22 | and cardiopulmonary resuscitation in accordance with standards | ||||||
23 | and requirements
established by the American Red Cross or | ||||||
24 | another qualified certifying agency.
No pupil shall be
required | ||||||
25 | to take or participate in any class or course on AIDS or family
| ||||||
26 | life instruction if his parent or guardian submits written |
| |||||||
| |||||||
1 | objection
thereto, and refusal to take or participate in the | ||||||
2 | course or program shall
not be reason for suspension or | ||||||
3 | expulsion of the pupil.
| ||||||
4 | Curricula developed under programs established in | ||||||
5 | accordance with this
Act in the major educational area of | ||||||
6 | alcohol and drug use and abuse shall
include classroom | ||||||
7 | instruction in grades 5 through 12. The instruction,
which | ||||||
8 | shall include matters relating to both the physical and legal | ||||||
9 | effects
and ramifications of drug and substance abuse, shall be | ||||||
10 | integrated into
existing curricula; and the State Board of | ||||||
11 | Education shall develop and make
available to all elementary | ||||||
12 | and secondary schools in this State
instructional materials and | ||||||
13 | guidelines which will assist the schools in
incorporating the | ||||||
14 | instruction into their existing curricula. In
addition, school | ||||||
15 | districts may offer, as part of existing curricula during
the | ||||||
16 | school day or as part of an after school program, support | ||||||
17 | services and
instruction for pupils or pupils whose parent, | ||||||
18 | parents, or guardians are
chemically dependent.
