    Amends the State Finance Act, the Illinois Income Tax Act, the Illinois Vehicle Code, and the Illinois Identification Card Act. Provides that an applicant for a driver's license or instruction permit, a commercial driver's license or instruction permit, or a State identification card shall be asked if he or she wants to donate $1 to the Juvenile Diabetes Research and Nutritional Health Trust Fund, in addition to any other applicable fees. Creates the Juvenile Diabetes Research and Nutritional Health Trust Fund as a special fund in the State treasury. Provides that all moneys in the Juvenile Diabetes Research and Nutritional Health Trust Fund shall be used by the Department of Public Health for juvenile diabetes research, nutritional health programs, education, and public awareness and to reimburse the Secretary of State for administrative costs relating to the $1 donations. Creates the Juvenile Diabetes Research and Nutritional Health Fund checkoff. Provides that the Department of Revenue shall print on its standard individual income tax form a provision indicating that if the taxpayer wishes to contribute to the Juvenile Diabetes Research and Nutritional Health Fund he or she may do so by stating the amount of the contribution on the return and that the contribution will reduce the taxpayer's refund or increase the amount of payment to accompany the return.

1     AN ACT in relation to juvenile diabetes research.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The State Finance Act is amended by adding
5 Section 5.675 as follows:
 
6     (30 ILCS 105/5.675 new)
7     Sec. 5.675. The Juvenile Diabetes Research and Nutritional
8 Health Trust Fund.
 
9     Section 10. The Illinois Identification Card Act is amended
10 by changing Section 5 as follows:
 
11     (15 ILCS 335/5)  (from Ch. 124, par. 25)
12     Sec. 5. Applications.
13     (a) Any natural person who is a resident of the State of
14 Illinois, may file an application for an identification card or
15 for the renewal thereof, in a manner prescribed by the
16 Secretary. Each original application shall be completed by the
17 applicant in full and shall set forth the legal name, residence
18 address and zip code, social security number, birth date, sex
19 and a brief description of the applicant. The applicant shall
20 be photographed and he shall also submit any other information
21 as the Secretary may deem necessary or such documentation as

1 the Secretary may require to determine the identity of the
2 applicant. An applicant for a disabled persons card must also
3 submit with each original or renewal application, on forms
4 prescribed by the Secretary, such documentation as the
5 Secretary may require, establishing that the applicant is a
6 "disabled person" as defined in Section 4A of this Act, and
7 setting forth the applicant's type and class of disability as
8 set forth in Section 4A of this Act.
9     (b) In addition to the fees collected under Section 12 of
10 this Act, the Secretary of State shall ask each person applying
11 for or renewing a State identification card whether the person
12 wishes to make a $1 voluntary contribution to the Juvenile
13 Diabetes Research and Nutritional Health Trust Fund
14 established under Section 6-106 of the Illinois Vehicle Code.
15 All donations collected under this subsection (b) shall be
16 deposited into the Juvenile Diabetes Research and Nutritional
17 Health Trust Fund.

19     Section 15. The Illinois Income Tax Act is amended by
20 adding Section 507OO as follows:
 
21     (35 ILCS 5/507OO new)
22     Sec. 507OO. The Juvenile Diabetes Research and Nutritional
23 Health Trust Fund checkoff. Beginning with taxable years ending
24 on or after December 31, 2008, the Department shall print on

1 its standard individual income tax form a provision indicating
2 that if the taxpayer wishes to contribute to the Juvenile
3 Diabetes Research and Nutritional Health Trust Fund, as
4 authorized by this amendatory Act of the 95th General Assembly,
5 he or she may do so by stating the amount of the contribution
6 (not less than $1) on the return and that the contribution will
7 reduce the taxpayer's refund or increase the amount of payment
8 to accompany the return. Failure to remit any amount of
9 increased payment shall reduce the contribution accordingly.
10 This Section shall not apply to any amended return.
 
11     Section 20. The Illinois Vehicle Code is amended by
12 changing Sections 6-106 and 6-510 as follows:
 
13     (625 ILCS 5/6-106)  (from Ch. 95 1/2, par. 6-106)
14     Sec. 6-106. Application for license or instruction permit.
15     (a) Every application for any permit or license authorized
16 to be issued under this Act shall be made upon a form furnished
17 by the Secretary of State. Every application shall be
18 accompanied by the proper fee and payment of such fee shall
19 entitle the applicant to not more than 3 attempts to pass the
20 examination within a period of 1 year after the date of
21 application.
22     (b) Every application shall state the legal name, social
23 security number, zip code, date of birth, sex, and residence
24 address of the applicant; briefly describe the applicant; state

1 whether the applicant has theretofore been licensed as a
2 driver, and, if so, when and by what state or country, and
3 whether any such license has ever been cancelled, suspended,
4 revoked or refused, and, if so, the date and reason for such
5 cancellation, suspension, revocation or refusal; shall include
6 an affirmation by the applicant that all information set forth
7 is true and correct; and shall bear the applicant's signature.
8 The application form may also require the statement of such
9 additional relevant information as the Secretary of State shall
10 deem necessary to determine the applicant's competency and
11 eligibility. The Secretary of State may in his discretion
12 substitute a federal tax number in lieu of a social security
13 number, or he may instead assign an additional distinctive
14 number in lieu thereof, where an applicant is prohibited by
15 bona fide religious convictions from applying or is exempt from
16 applying for a social security number. The Secretary of State
17 shall, however, determine which religious orders or sects have
18 such bona fide religious convictions. The Secretary of State
19 may, in his discretion, by rule or regulation, provide that an
20 application for a drivers license or permit may include a
21 suitable photograph of the applicant in the form prescribed by
22 the Secretary, and he may further provide that each drivers
23 license shall include a photograph of the driver. The Secretary
24 of State may utilize a photograph process or system most
25 suitable to deter alteration or improper reproduction of a
26 drivers license and to prevent substitution of another photo

1 thereon.
2     (c) The application form shall include a notice to the
3 applicant of the registration obligations of sex offenders
4 under the Sex Offender Registration Act. The notice shall be
5 provided in a form and manner prescribed by the Secretary of
6 State. For purposes of this subsection (c), "sex offender" has
7 the meaning ascribed to it in Section 2 of the Sex Offender
8 Registration Act.
9     (d) Any male United States citizen or immigrant who applies
10 for any permit or license authorized to be issued under this
11 Act or for a renewal of any permit or license, and who is at
12 least 18 years of age but less than 26 years of age, must be
13 registered in compliance with the requirements of the federal
14 Military Selective Service Act. The Secretary of State must
15 forward in an electronic format the necessary personal
16 information regarding the applicants identified in this
17 subsection (d) to the Selective Service System. The applicant's
18 signature on the application serves as an indication that the
19 applicant either has already registered with the Selective
20 Service System or that he is authorizing the Secretary to
21 forward to the Selective Service System the necessary
22 information for registration. The Secretary must notify the
23 applicant at the time of application that his signature
24 constitutes consent to registration with the Selective Service
25 System, if he is not already registered.
26     (e) In addition to the fees collected under Section 6-118

1 of this Act, the Secretary of State shall ask each person
2 applying for or renewing a license or instruction permit
3 whether the person wishes to make a $1 voluntary contribution
4 to the Juvenile Diabetes Research and Nutritional Health Trust
5 Fund established under this Section. All donations collected
6 under this subsection (e) shall be deposited into the Juvenile
7 Diabetes Research and Nutritional Health Trust Fund.
8     (f) The Juvenile Diabetes Research and Nutritional Health
9 Trust Fund is created as a special fund in the State treasury.
10 All moneys in the Juvenile Diabetes Research and Nutritional
11 Health Trust Fund shall, subject to appropriation by the
12 General Assembly and approval by the Secretary of State, be
13 used by the Department of Public Health for the following
14 purposes:
15         (1) Development and implementation of a campaign that
16     explains and promotes the Juvenile Diabetes Research and
17     Nutritional Health Trust Fund;
18         (2) Development and implementation of juvenile
19     diabetes research programs and related nutritional health
20     programs;
21         (3) Development and implementation of local and
22     statewide public education programs about juvenile
23     diabetes and nutritional health;
24         (4) Development and distribution of materials raising
25     awareness of juvenile diabetes and nutritional health;
26         (5) Development and implementation of local and

1     statewide juvenile diabetes awareness programs in
2     secondary schools;
3         (6) Development and implementation of a nutritional
4     awareness hotline;
5         (7) Reimbursement of the Secretary of State for
6     administrative costs incurred in the performance of duties
7     under subsection (e) of this Section, subsection (b) of
8     Section 6-510 of this Code, and subsection (b) of Section 5
9     of the Illinois Identification Card Act.
10     (g) The Director of Public Health shall make the materials
11 developed under subsection (f) of this Section available to
12 other State agencies.

15     Sec. 6-510. Application for Commercial Driver's License
16 (CDL).
17     (a) The application for a CDL or commercial driver
18 instruction permit, must include, but not necessarily be
19 limited to, the following:
20         (1) the full legal name and current Illinois
21     domiciliary address (unless the application is for a
22     Non-resident CDL) of the applicant;
23         (2) a physical description of the applicant including
24     sex, height, weight, color of eyes and hair color;
25         (3) date of birth;

1         (4) the applicant's social security number or other
2     identifying number acceptable to the Secretary of State;
3         (5) the applicant's signature;
4         (6) certifications required by 49 C.F.R. Part 383.71;
5         (6.1) the names of all states where the applicant has
6     previously been licensed to drive any type of motor vehicle
7     during the previous 10 years pursuant to 49 C.F.R. Part
8     383; and
9         (7) any other information required by the Secretary of
10     State.
11     (b) In addition to the fees collected under Section 6-118
12 of this Act, the Secretary of State shall ask each person
13 applying for or renewing a CDL or commercial instruction permit
14 whether the person wishes to make a $1 voluntary contribution
15 to the Juvenile Diabetes Research and Nutritional Health Trust
16 Fund established under Section 6-106 of this Code. All
17 donations collected under this subsection (b) shall be
18 deposited into the Juvenile Diabetes Research and Nutritional
19 Health Trust Fund.
