AMENDMENT TO HOUSE BILL 2801

2     AMENDMENT NO. ______. Amend House Bill 2801 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Adjutant General, on behalf of the State of
5 Illinois and the Department of Military Affairs, is authorized
6 to convey by Quitclaim Deed all right, title, and interest of
7 the State of Illinois and the Department of Military Affairs in
8 and to the real estate described in Section 10 to the City of
9 Monmouth, subject to the conditions and restrictions described
10 in Section 15.
 
11     Section 10. The Adjutant General is authorized to convey
12 the following described real property:
 
13     Parcel 1: All of Lot Three (3) in Block Twenty-Six (26) of
14 the Old Town Plat of the City of Monmouth, Illinois.

1     Parcel 2: Thirty-eight and sixty-three hundredths (38.63)
2 feet off the West end of Lot Four (4) in Block Twenty-Six (26)
3 of the Old Town Plat of the City of Monmouth, Illinois.
 
4     Parcel 3: A part of Lot Two (2) of Lot Five (5) in Block
5 Twenty-Six (26) of the Old Town Plat of the City of Monmouth,
6 Illinois, described as follows:
 
7 Commencing at the Northwest corner of Lot Two (2) of the
8 subdivision of Lot Five (5) of Block Twenty-Six (26) of the Old
9 Town Plat of the City of Monmouth, running thence east along
10 the north line of said Lot Two (2) to the Northeast corner of
11 said Lot Two (2), about two hundred three and twenty-eight
12 hundredths (203.28) feet, thence south to the south line of
13 said Lot Two (2), thence west seventy-one and twenty-eight
14 hundredths (71.28) feet, thence north sixty (60) feet, thence
15 west to the west line of said Lot Two (2), thence north to the
16 place of beginning, as shown by Plat of said subdivision
17 recorded in Vol. 27 on page 58 of Deed records of Warren
18 County, Illinois.
 
19     Parcel 4: The East half of the East half of Lot One (1) in
20 Block Twenty-Six (26) of the Old Town Plat of the City of
21 Monmouth, Illinois; subject to and including an easement, the
22 terms of which are recorded in Book 91, page 497 of the records
23 in the Recorder's Office of Warren County, Illinois, and

1 subject to any rights to maintain sewers under said premises.
 
2     Parcel 5: The West half of the East half of Lot One (1) in
3 Block Twenty-Six (26) of the Old Town Plat of the City of
4 Monmouth, Illinois; with perpetual right of ingress and egress
5 for a driveway, as shown by deed dated February 23, 1898 and
6 recorded in Volume 91, page 497, of the Deed Records of Warren
7 County, Illinois.
 
8     Parcel 6: Lot Four (4) in Block Twenty-Six (26) of the Old
9 Town Plat of the City of Monmouth, Illinois, except
10 thirty-eight and sixty-three hundredths (38.63) feet off of the
11 West end of said Lot 4, and except fifteen (15) feet off of the
12 North side of said Lot 4, situated in the City of Monmouth,
13 Warren County, Illinois.
 
14     Section 15. The Adjutant General shall not convey the above
15 real property to the City of Monmouth until the Adjutant
16 General determines that the property is no longer required for
17 military purposes. In this regard, construction of the new
18 Readiness Center in Galesburg must be completed, and all
19 military units with associated equipment must have been
20 transferred from the armory property described in Section 10 to
21 the new Readiness Center in Galesburg. Conveyance of the above
22 real property will be in an "as is" condition, subject to an
23 Historic Preservation Covenant on the armory buildings as

1 approved by the Illinois Historic Preservation Agency, and the
2 City of Monmouth will pay all required costs and expenses of
3 the conveyance, as determined by the Adjutant General.
 
4     Section 20. The Adjutant General shall obtain a certified
5 copy of this Act from the Secretary of State within 60 days
6 after its effective date and, upon conveyance of the real
7 estate described in Section 10 being made, shall cause the
8 certified copy of this Act to be recorded in the office of the
9 recorder of Warren County, Illinois.
 
10     Section 99. Effective date. This Act takes effect upon
11 becoming law.".
