2 | AMENDMENT NO. ______. Amend House Bill 2304 by replacing | ||||||
3 | everything after the enacting clause with the following:
| ||||||
4 | "Section 5. "An Act in relation to certain land", approved | ||||||
5 | June 13, 2000, Public Act 91-824, is amended by changing | ||||||
6 | Section 20-10 as follows: | ||||||
7 | (P.A. 91-824, Sec. 20-10)
| ||||||
8 | Sec. 20-10. The Director of Central Management Services is | ||||||
9 | authorized to:
| ||||||
10 | (a) convey by quit claim deed for $1 buildings A & B of | ||||||
11 | the former Henry
Horner School property located on Oak Park | ||||||
12 | Ave, Chicago, Illinois to Maryville
Academy, provided | ||||||
13 | however that should the property fail to be used by | ||||||
14 | Maryville
Academy for
charitable or educational purposes, | ||||||
15 | the title shall revert to the State of
Illinois;
| ||||||
16 | (b) convey by quit claim deed approximately 5 acres of |

| |||||||
1 | the grounds
of the former Henry Horner School located on | ||||||
2 | Oak Park Avenue, Chicago, Illinois
for $1 upon | ||||||
3 | identification and survey of a site mutually agreeable to | ||||||
4 | the
parties to New Horizon Center for the Developmentally | ||||||
5 | Disabled, provided that
should the property fail to be used | ||||||
6 | by New Horizon Center for the
Developmentally Disabled for | ||||||
7 | charitable or
educational purposes,
title shall revert to | ||||||
8 | the State of Illinois;
| ||||||
9 | (c) convey by Quit Claim Deed for $1 to the City of | ||||||
10 | Chicago the following
described real property:
| ||||||
11 | A PARCEL OF LAND, APPROXIMATELY 16,000 SQUARE FEET ON | ||||||
12 | AND ALONG THE NORTH
SIDE OF WEST IRVING PARK ROAD, | ||||||
13 | HAVING APPROXIMATELY 135 FEET OF FRONTAGE ON
SAID WEST | ||||||
14 | IRVING PARK ROAD AND A DEPTH OF APPROXIMATELY 125 FEET, | ||||||
15 | HAVING ITS
EASTERLY BOUNDARY PARALLEL TO AND | ||||||
16 | APPROXIMATELY 1,111 FEET WEST OF THE WEST
PROPERTY LINE | ||||||
17 | OF NORTH NARRAGANSETT AVENUE, AND ITS WESTERLY | ||||||
18 | BOUNDARY BEING
PARALLEL TO AND 135 FEET WEST OF THE | ||||||
19 | EASTERLY BOUNDARY LINE, ALL IN THE COUNTY
OF COOK AND | ||||||
20 | STATE OF ILLINOIS.

21 | Provided however, should the property fail to be used by | ||||||
22 | the Grantee for
public purposes, title shall revert to the | ||||||
23 | State of Illinois;
| ||||||
24 | (d) take steps to preserve, landscape, memorialize and | ||||||
25 | protect unmarked
historic cemetery grounds located by | ||||||
26 | archeological survey on the grounds of
Chicago Read Mental |

| |||||||
1 | Health Center. This subsection shall also allow the
| ||||||
2 | relocation of the remains pursuant to regulations and | ||||||
3 | procedures established by
the Historic Preservation Agency | ||||||
4 | when deemed necessary by the Director
of Central Management | ||||||
5 | Services. For the purpose of the relocation of such
| ||||||
6 | remains, the Secretary of Human Services is designated next | ||||||
7 | of kin when it is
not possible to definitively establish | ||||||
8 | the identity of any such remains;
| ||||||
9 | (e) (blank)
in order to facilitate the conveyances | ||||||
10 | referenced in subsections (a)
and (b) after consultation | ||||||
11 | with the Secretary of Transportation, the
Secretary of | ||||||
12 | Human
Services, and the Director of Commerce and Community | ||||||
13 | Affairs and upon
obtaining
necessary appraisals, surveys, | ||||||
14 | and environmental reports, and in accordance
with
and in | ||||||
15 | coordination with any pre-existing redevelopment | ||||||
16 | agreement,
convey title by quit claim deed to Chicago
Read | ||||||
17 | Joint Venture, Limited Partnership to surplus property | ||||||
18 | located within the
area bordered by Harlem Avenue, West | ||||||
19 | Irving Park Road, North Narragansett
Avenue, West Montrose | ||||||
20 | Avenue, and Forest Preserve Drive, Chicago, Illinois, but
| ||||||
21 | excluding the area comprised of the property of the former | ||||||
22 | Henry Horner School
and the property referred to as the | ||||||
23 | "Phase Three Property" under the Chicago
Read-Dunning | ||||||
24 | Redevelopment Agreement, at
fair market value and on
such | ||||||
25 | terms and conditions necessary to bring about the orderly | ||||||
26 | redevelopment of
such surplus property, provided however |

| |||||||
1 | that "surplus property" as described in
this Section shall | ||||||
2 | not include buildings and grounds currently under the
| ||||||
3 | jurisdiction of the Department of Human Services unless | ||||||
4 | specifically consented
to by the Secretary of Human | ||||||
5 | Services ; and
| ||||||
6 | (f) accept replacement State facilities constructed
in | ||||||
7 | order to relocate State
operations located in facilities to | ||||||
8 | be replaced or otherwise transferred to
coordinate with | ||||||
9 | necessary redevelopment.

11 | Section 10. The Director of Central Management Services | ||||||
12 | shall obtain a certified copy this Act within 60 days after its | ||||||
13 | effective date, and shall record the certified document in the | ||||||
14 | Recorder's Office in the county in which the land is located. | ||||||
15 | Section 99. Effective date. This Act takes effect upon | ||||||
16 | becoming law.".
