2 | AMENDMENT NO. ______. Amend House Bill 2167 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The Environmental Protection Act is amended by | ||||||
5 | adding Section 17.9 as follows: | ||||||
6 | (415 ILCS 5/17.9 new) | ||||||
7 | Sec. 17.9. Task Force on Pharmaceuticals and Personal Care | ||||||
8 | Products and Other Emerging Contaminants in Drinking Water. | ||||||
9 | (a) The Task Force on Pharmaceuticals and Personal Care | ||||||
10 | Products and Other Emerging Contaminants in Drinking Water | ||||||
11 | (Task Force) is established for the purpose of a larger | ||||||
12 | understanding of the environmental consequences of the use of | ||||||
13 | these products that are being found in drinking water. | ||||||
14 | (b) The Task Force shall consist of the Director of the | ||||||
15 | Illinois Environmental Protection Agency (Agency) or his or her | ||||||
16 | designee and 7 members appointed by the Director. Appointed |

1 | members must possess knowledge and expertise in the fields | ||||||
2 | relevant to testing community water supplies, both surface and | ||||||
3 | groundwater systems, including but not limited to analytical | ||||||
4 | chemistry, pharmacology/toxicology, risk assessment, and | ||||||
5 | hydrology. The Task Force shall initially focus on evaluating | ||||||
6 | pharmaceuticals and personal care products and other "emerging | ||||||
7 | contaminants", as the Task Force deems appropriate. The members | ||||||
8 | of the Task Force may organize themselves as they deem | ||||||
9 | necessary and shall serve without compensation. The Task Force | ||||||
10 | shall evaluate the environmental consequences considering the | ||||||
11 | following, conducted by the U.S. Environmental Protection | ||||||
12 | Agency, pursuant to the Safe Drinking Water and Clean Water | ||||||
13 | Acts and United States Geological Survey (USGS): | ||||||
14 | (1) Research data analyzing the effect of emerging | ||||||
15 | contaminants on aquatic wildlife, including fish, and any | ||||||
16 | evidence linking that research data to human health | ||||||
17 | problems. | ||||||
18 | (2) The accuracy of current technology (analytical | ||||||
19 | procedures) for testing trace amounts of emerging | ||||||
20 | contaminants (both individual and mixtures of chemicals), | ||||||
21 | including the estimated costs of that testing and | ||||||
22 | laboratories qualified to do that testing. | ||||||
23 | (3) Standards and guidance, from federal or other | ||||||
24 | international sources for the testing of both individual | ||||||
25 | and mixtures of chemicals, and analytical procedures | ||||||
26 | established by the U.S. Environmental Protection Agency |

2 | (4) USGS National Reconnaissance of Pharmaceuticals, | ||||||
3 | Hormones and Other Organic Wastewater Contaminants in U.S. | ||||||
4 | Streams to determine environmental consequences. | ||||||
5 | (c) No later than December 31, 2009, the Task Force shall | ||||||
6 | submit its findings, along with recommendations for | ||||||
7 | legislation, to the General Assembly. The Agency shall also | ||||||
8 | post the findings of the Task Force evaluation on its web site. | ||||||
9 | (d) Repealer. This Section is repealed on July 1, 2011.

10 | Section 99. Effective date. This Act takes effect upon | ||||||
11 | becoming law.".
