| AN ACT concerning civil law.
|

| Be it enacted by the People of the State of Illinois, |
3 |
| represented in the General Assembly:
|

| Section 5. The Adoption Act is amended by changing Section |
5 |
| 13.1 as follows:
|

| (750 ILCS 50/13.1)
|

| Sec. 13.1. Order for standby adoption.
|
8 |
| (a) If it is proved to the
the satisfaction of the court, |
9 |
| after such
investigation as the court deems necessary, that the |
10 |
| child's parent
consents to or fails to object to the standby |
11 |
| adoption and adoption by the
petitioner will be for the welfare |
12 |
| of the child, the court may
enter an order for standby |
13 |
| adoption. However, the consenting
parent's parental rights may |
14 |
| not be terminated until consent
becomes effective. |
15 |
| (b) The order for standby adoption shall be final as to all |
16 |
| findings and
shall be followed in the judgment of adoption |
17 |
| unless the
court finds by clear and convincing evidence that it |
18 |
| is no longer in the best
interest of the child for the adoption |
19 |
| to be finalized.

| (c) Once the standby adoptive parent receives knowledge of |
21 |
| the
death of the consenting parent, or the consenting parent
|
22 |
| requests that a final judgment for adoption be entered, the |
23 |
| standby
adoptive parent shall have 60 days to apply for a |
