Amends the Public Utilities Act. Provides that in the event that a public utility that provides electric service reorganizes to plan an electrical power generating facility in an unregulated subsidiary, and notwithstanding specified provisions, the Illinois Commerce Commission shall approve rates for the public utility that include the wholesale cost of electricity that are equal to or less than the price of comparable power purchased from other electric suppliers on the spot market, exchange market, and other market-based mechanisms for electric power. Effective immediately.

| AN ACT concerning regulation.

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Public Utilities Act is amended by adding |
5 |
| Section 9-209 as follows: |

| (220 ILCS 5/9-209 new) |

| Sec. 9-209. Inclusion of the cost of wholesale electric |
8 |
| power in rate approval. In the event that a public utility that |
9 |
| provides electric service reorganizes to plan an electrical |
10 |
| power generating facility in an unregulated subsidiary, and |
11 |
| notwithstanding the provisions of Sections 9-220, 16-103, |
12 |
| 16-113, 16-119A, and 16-126 of this Act, the Commission shall |
13 |
| approve rates for the public utility that include the wholesale |
14 |
| cost of electricity that are equal to or less than the price of |
15 |
| comparable power purchased from other electric suppliers on the |
16 |
| spot market, exchange market, and other market-based |
17 |
| mechanisms for electric power.

| Section 99. Effective date. This Act takes effect upon |
19 |
| becoming law.
