Amends the Methamphetamine Control and Community Protection Act. Provides that a person who tampers with farm equipment without the consent of the owner of that equipment for the purpose of facilitating the manufacture or delivery of methamphetamine in violation of the Act and who is convicted of criminal damage to property in relation to the farm equipment or theft or trespass or burglary to the farm equipment shall be required to make restitution to the owner of the farm equipment in an amount equal to twice the value of the farm equipment. Provides that the convicted person shall make this restitution in addition to any other fine or penalty required by law.

| AN ACT concerning criminal law.

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Methamphetamine Control and Community |
5 |
| Protection Act is amended by adding Section 91 as follows: |
6 |
| (720 ILCS 646/91 new) |

| Sec. 91. Methamphetamine restitution; farm equipment. |
8 |
| (a) A person who tampers with farm equipment without the |
9 |
| consent of the owner of that equipment for the purpose of |
10 |
| facilitating the manufacture or delivery of methamphetamine in |
11 |
| violation of this Act and who is convicted of a violation of |
12 |
| this Act or of Section 16-1, 19-1, 21-1, or 21-3 of the |
13 |
| Criminal Code of 1961 in relation to the farm equipment shall |
14 |
| be required to make restitution to the owner of the farm |
15 |
| equipment in an amount equal to twice the value of the farm |
16 |
| equipment. The convicted person shall make this restitution in |
17 |
| addition to any other fine or penalty required by law. |
18 |
| (b) For the purposes of this Section, "farm equipment" |
19 |
| means machinery or other equipment used in farming; and |
20 |
| "tampers" means to damage, trespass, burglarize, or commit a |
21 |
| theft of the farm equipment.
