1 | AN ACT concerning public aid.
| ||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Illinois Public Aid Code is amended by | ||||||
5 | adding Section 5-2.4 as follows: | ||||||
6 | (305 ILCS 5/5-2.4 new) | ||||||
7 | Sec. 5-2.4. Pilot project; certain persons with | ||||||
8 | disabilities. | ||||||
9 | (a) The Department of Healthcare and Family Services shall | ||||||
10 | operate a pilot project to determine the effect of raising the | ||||||
11 | income and non-exempt asset eligibility thresholds for certain | ||||||
12 | persons with disabilities on those persons' ability to maintain | ||||||
13 | their homes in the community and avoid institutionalization. | ||||||
14 | Enrollment under the pilot project shall be limited to 50 | ||||||
15 | persons per year. Persons who become eligible under this | ||||||
16 | project shall remain eligible for medical assistance unless | ||||||
17 | they no longer meet the standards under which they were | ||||||
18 | determined eligible under the project. Eligibility for medical | ||||||
19 | assistance under this Section shall cease once a person obtains | ||||||
20 | other health coverage considered adequate to meet his or her | ||||||
21 | health care needs. | ||||||
22 | (b) Persons who meet all of the following criteria may be | ||||||
23 | enrolled under the pilot project: |

1 | (1) they initially enrolled for medical assistance | ||||||
2 | under paragraph 2(a)(ii) of Section 5-2; | ||||||
3 | (2) subsequent to initial enrollment, they are | ||||||
4 | otherwise qualified under paragraph 2(a)(i) of Section | ||||||
5 | 5-2, except that their income, as determined by the | ||||||
6 | Department, exceeds 100% of the poverty guidelines updated | ||||||
7 | periodically in the Federal Register by the U.S. Department | ||||||
8 | of Health and Human Services under authority of 42 U.S.C. | ||||||
9 | 9902(2) ("the federal poverty income guidelines"); | ||||||
10 | (3) they were at least 60 years of age but less than 65 | ||||||
11 | years of age upon initial enrollment for medical | ||||||
12 | assistance; | ||||||
13 | (4) they have income no greater than 200% of the | ||||||
14 | federal poverty income guidelines; and | ||||||
15 | (5) they have non-exempt assets no greater than | ||||||
16 | $10,000. | ||||||
17 | (c) In order to provide for the expeditious and timely | ||||||
18 | implementation of this Section, the Department of Healthcare | ||||||
19 | and Family Services may adopt rules necessary to implement this | ||||||
20 | Section through the use of emergency rulemaking in accordance | ||||||
21 | with Section 5-45 of the Illinois Administrative Procedure Act. | ||||||
22 | The General Assembly finds that the adoption of rules to | ||||||
23 | implement this Section is deemed an emergency and necessary for | ||||||
24 | the public interest, safety, and welfare. | ||||||
25 | (d) This Section is repealed on June 30, 2012.

26 | Section 99. Effective date. This Act takes effect upon |
