1 | AMENDMENT TO HOUSE BILL 1263

2 | AMENDMENT NO. ______. Amend House Bill 1263 as follows:

3 | on page 2, line 15, by changing "Section 507OO" to "Sections | ||||||
4 | 507OO and 509.1"; and | ||||||
5 | on page 4, immediately below line 24, by inserting the | ||||||
6 | following: | ||||||
7 | "(35 ILCS 5/509.1 new) | ||||||
8 | Sec. 509.1. Removal of excess tax-checkoff funds. | ||||||
9 | Notwithstanding any provisions of this Act to the contrary, | ||||||
10 | beginning on the effective date of this amendatory Act of the | ||||||
11 | 95th General Assembly, there may not be more than 15 | ||||||
12 | tax-checkoff funds contained on the individual tax return form | ||||||
13 | at any one time. Each year, the Department shall determine | ||||||
14 | whether the sum of (i) the number of new tax-checkoff funds | ||||||
15 | created by the General Assembly during that year plus (ii) the |

1 | number of tax-checkoff funds that collected at least $100,000 | ||||||
2 | during the previous year exceeds 15. If so, then the Department | ||||||
3 | shall remove a number of tax checkoff funds that were on the | ||||||
4 | return during the previous year that is equal to the sum of | ||||||
5 | items (i) and (ii) minus 15, starting with the tax | ||||||
6 | checkoff-fund that received the least amount of contributions | ||||||
7 | and working upward until a sufficient number of funds have been | ||||||
8 | removed. ".
