Amends the Child Care Act of 1969. Provides that no day care center, day care home, or group day care home license or permit may be issued or renewed, unless the Department has been presented with satisfactory proof that all persons operating and employed by the day care facility have submitted to and successfully passed a drug screening conducted by an entity approved by the Department, and that the day care facility has instituted a policy of periodic drug screening of all persons operating and employed by the day care center facility.

| AN ACT concerning regulation.

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Child Care Act of 1969 is amended by adding |
5 |
| Section 5.7 as follows: |
6 |
| (225 ILCS 10/5.7 new) |
7 |
| Sec. 5.7. Drug screening required. No day care center, day |
8 |
| care home, or group day care home license or permit may be |
9 |
| issued or renewed under this Act, unless the Department has |
10 |
| been presented with satisfactory proof that all persons |
11 |
| operating and employed by the day care center, day care home, |
12 |
| or group day care home have submitted to and successfully |
13 |
| passed a drug screening conducted by an entity approved by the |
14 |
| Department, and that the day care center, day care home, or |
15 |
| group day care home has instituted a policy of periodic drug |
16 |
| screening of all persons operating and employed by the day care |
17 |
| center, day care home, or group day care home. The Department |
18 |
| shall adopt all rules necessary for the administration of this |
19 |
| Section.
