2 | AMENDMENT NO. ______. Amend House Bill 1011 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The Public Utilities Act is amended by adding
| ||||||
5 | Section 16-107.5 as follows:
| ||||||
6 | (220 ILCS 5/16-107.5 new)
| ||||||
7 | Sec. 16-107.5. Net energy metering.
| ||||||
8 | (a) The Legislature finds and declares that a program to | ||||||
9 | provide net energy
metering for eligible customers can | ||||||
10 | encourage private investment in renewable
energy resources, | ||||||
11 | stimulate economic
growth, enhance the continued | ||||||
12 | diversification of Illinois' energy resource mix,
and protect | ||||||
13 | the Illinois environment.
| ||||||
14 | (b) As used in this Section: (i) an "eligible customer" | ||||||
15 | means a retail customer that owns and operates a solar or wind | ||||||
16 | electrical generating facility with a stated name plate |

1 | capacity of not more than 40 kilowatts that is located on the | ||||||
2 | customer's premises and is intended to offset part or all of | ||||||
3 | the customer's own electrical requirements and (ii) "net energy | ||||||
4 | metering" means the use of a secondary energy meter to measure | ||||||
5 | the amount of electricity provided to the electric utility by | ||||||
6 | the customer.

7 | (c) An eligible customer shall pay for all costs associated | ||||||
8 | with the electric utility providing the required | ||||||
9 | interconnection and secondary meter needed, and if necessary | ||||||
10 | the real time pricing equipment needed, to participate in net | ||||||
11 | energy metering.
| ||||||
12 | (d) Eligible customers participating in net energy | ||||||
13 | metering with electric utilities serving 200,000 or more | ||||||
14 | customers shall be reimbursed for the electricity supplied to | ||||||
15 | the utility based upon real-time pricing. | ||||||
16 | (e) Eligible customers participating in net energy | ||||||
17 | metering with electric utilities serving less than 200,000 | ||||||
18 | customers shall be reimbursed for the electricity supplied to | ||||||
19 | the utility based upon the utility's avoided cost. | ||||||
20 | (f) The electric utility shall make all payments to | ||||||
21 | eligible customers promptly. | ||||||
22 | (g) Within 3 months after the effective date of this | ||||||
23 | amendatory Act of the 95th General Assembly, the Illinois | ||||||
24 | Commerce Commission shall establish standards for net energy | ||||||
25 | metering and the interconnection of solar and wind electric | ||||||
26 | generating equipment to the utility system if the Commission |

1 | determines that such standards are necessary for safe and | ||||||
2 | adequate service and further the public policy set forth in | ||||||
3 | this Section. The standards may include, but shall not be | ||||||
4 | limited to, standards designating: | ||||||
5 | (1) equipment necessary to automatically isolate the | ||||||
6 | residential solar and wind generating system from the | ||||||
7 | utility system for voltage and frequency deviations; and | ||||||
8 | (2) a manual lockable disconnect switch provided by the | ||||||
9 | customer which shall be located on the outside of the | ||||||
10 | residence and externally accessible for the purpose of | ||||||
11 | isolating the solar and wind electric generating | ||||||
12 | equipment.

13 | (h) An electric utility shall offer net metering to | ||||||
14 | eligible customers until the load of its net energy metering | ||||||
15 | customers equals 0.1% of the total peak demand supplied by the | ||||||
16 | electric utility during the previous year. Electric utilities | ||||||
17 | are authorized to offer net energy metering beyond 0.1% of peak | ||||||
18 | load if they so choose.

19 | Section 99. Effective date. This Act takes effect upon | ||||||
20 | becoming law.".
