1 | AMENDMENT TO HOUSE BILL 796

2 | AMENDMENT NO. ______. Amend House Bill 796 as follows:

3 | on page 4, lines 12 and 13, by deleting "in accordance with | ||||||
4 | rules adopted by the Department"; and | ||||||
5 | on page 4, line 15, by deleting "by rule"; and | ||||||
6 | on page 9, line 5, by replacing "rulemaking" with "no authority | ||||||
7 | to make or promulgate rules"; and | ||||||
8 | on page 9, by replacing lines 11 and 12 with the following: | ||||||
9 | "(b) Notwithstanding any other rulemaking authority that | ||||||
10 | may exist, neither the Governor nor any agency or agency head | ||||||
11 | under the jurisdiction of the Governor has any authority to | ||||||
12 | make or promulgate rules to implement or enforce the provisions | ||||||
13 | of this Act. If, however, the Governor believes that rules are | ||||||
14 | necessary to implement or enforce the provisions of this Act, |

1 | the Governor may suggest rules to the General Assembly by | ||||||
2 | filing them with the Clerk of the House and Secretary of the | ||||||
3 | Senate and by requesting that the General Assembly authorize | ||||||
4 | such rulemaking by law, enact those suggested rules into law, | ||||||
5 | or take any other appropriate action in the General Assembly's | ||||||
6 | discretion. Nothing contained in this Act shall be interpreted | ||||||
7 | to grant rulemaking authority under any other Illinois statute | ||||||
8 | where such authority is not otherwise explicitly given. For the | ||||||
9 | purposes of this Act, "rules" is given the meaning contained in | ||||||
10 | Section 1-70 of the Illinois Administrative Procedure Act, and | ||||||
11 | "agency" and "agency head" are given the meanings contained in | ||||||
12 | Sections 1-20 and 1-25 of the Illinois Administrative Procedure | ||||||
13 | Act to the extent that such definitions apply to agencies or | ||||||
14 | agency heads under the jurisdiction of the Governor.".
