1 | AN ACT concerning State government.

2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Illinois Coal and Energy Development Bond | ||||||||||||||||||||||||||
5 | Act is amended by changing Section 6 as follows:
| ||||||||||||||||||||||||||

| ||||||||||||||||||||||||||
7 | Sec. 6. Expenditure of funds.
The Department of Commerce | ||||||||||||||||||||||||||
8 | and Economic Opportunity is
authorized to use $120,000,000 for | ||||||||||||||||||||||||||
9 | the purposes specified in this Act. These
funds shall be | ||||||||||||||||||||||||||
10 | expended only for a grant to
the owner of a municipal | ||||||||||||||||||||||||||
11 | generating station located in Sangamon County, Illinois and | ||||||||||||||||||||||||||
12 | having at least
2
three coal-fired generating units with | ||||||||||||||||||||||||||
13 | accredited summer capacity greater
than 100
500 megawatts each | ||||||||||||||||||||||||||
14 | at such generating station as specifically
authorized by this | ||||||||||||||||||||||||||
15 | paragraph. Notwithstanding any of the other provisions of
this | ||||||||||||||||||||||||||
16 | Act, in considering the approval of projects to be funded under | ||||||||||||||||||||||||||
17 | this Act,
the Department of Commerce and Economic Opportunity | ||||||||||||||||||||||||||
18 | shall give
special consideration to projects which are designed | ||||||||||||||||||||||||||
19 | to remove sulfur and
other pollutants in the preparation and | ||||||||||||||||||||||||||
20 | utilization of coal, and in the use
and operation of electric | ||||||||||||||||||||||||||
21 | utility generating plants and industrial
facilities which | ||||||||||||||||||||||||||
22 | utilize Illinois coal as their primary source of fuel.
The | ||||||||||||||||||||||||||
23 | Department of Commerce and Community Affairs (now Department of |

| |||||||
1 | Commerce and Economic Opportunity) is directed to
enter into a | ||||||
2 | contract with the owner of a municipal generating station | ||||||
3 | located in Sangamon County,
Illinois and having at least 2
| ||||||
4 | three coal-fired generating units with
accredited summer | ||||||
5 | capability greater than 100
500 megawatts each at such
| ||||||
6 | generating station for a grant of $35,000,000 to be made by the | ||||||
7 | State of
Illinois to such owner to be used to pay costs of | ||||||
8 | designing, acquiring,
constructing, installing and testing | ||||||
9 | facilities to reduce sulfur dioxide
emissions at one newly | ||||||
10 | developed
such generating unit to allow that unit to meet the
| ||||||
11 | requirements of the Federal Clean Air Act Amendments of 1990 | ||||||
12 | (P.L. 101-549)
while continuing to use coal mined in Illinois | ||||||
13 | as its source of fuel.

15 | Section 10. The General Obligation Bond Act is amended by | ||||||
16 | changing Section 7 as follows:

19 | $663,200,000 is
authorized to be used by the Department of | ||||||
20 | Commerce and Economic Opportunity (formerly Department of | ||||||
21 | Commerce and Community Affairs) for
coal and energy development | ||||||
22 | purposes, pursuant to Sections 2, 3 and 3.1 of the
Illinois | ||||||
23 | Coal and Energy Development Bond Act, for the purposes
| ||||||
24 | specified
in Section 8.1 of the Energy Conservation and Coal |

| |||||||
1 | Development Act, and for
the purposes specified in Section | ||||||
2 | 605-332 of the Department of Commerce and
Economic Opportunity | ||||||
3 | Law of the Civil Administrative Code of Illinois. Of this
| ||||||
4 | amount:
| ||||||
5 | (a) $115,000,000 is
for the specific purposes of | ||||||
6 | acquisition,
development, construction, reconstruction, | ||||||
7 | improvement, financing,
architectural and technical planning | ||||||
8 | and installation of capital facilities
consisting of | ||||||
9 | buildings, structures, durable equipment, and land for the
| ||||||
10 | purpose of capital development of coal resources within the | ||||||
11 | State and for the
purposes specified in Section 8.1 of the | ||||||
12 | Energy Conservation and Coal
Development Act;
| ||||||
13 | (b) $35,000,000 is for the purposes specified in Section | ||||||
14 | 8.1 of the
Energy
Conservation and Coal Development Act and | ||||||
15 | making a grant to the owner of a municipal
generating station
| ||||||
16 | located in Sangamon County, Illinois and having at least 2
| ||||||
17 | three coal-fired generating units
with accredited summer | ||||||
18 | capability greater than 100
500 megawatts each at a newly | ||||||
19 | developed
such
generating station as provided in Section 6 of | ||||||
20 | that Bond Act;
| ||||||
21 | (c) $13,200,000 is for research, development and | ||||||
22 | demonstration
of forms of energy
other than that derived from | ||||||
23 | coal, either on or off State property; and
| ||||||
24 | (d) $500,000,000 is for the purpose of providing financial | ||||||
25 | assistance to
new
electric generating facilities as provided in | ||||||
26 | Section 605-332 of the Department
of Commerce and Economic |
