Creates the Illinois Health Policy Authority Act. Establishes the Illinois Health Policy Authority as an advisory body on July 1, 2008. Provides for membership and organization of the Authority. Abolishes the Authority on July 1, 2014. Provides that the Authority shall develop and maintain a coordinated health policy agenda that combines effective purchasing and administration of health care with health promotion oriented public health strategies, for the purpose of improving the health of the people of Illinois by increasing the quality, efficiency, and effectiveness of health care services and public health programs. Requires annual reports to the General Assembly. Effective immediately.

| AN ACT concerning health.
|

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 1. Short title. This Act may be cited as the |
5 |
| Illinois Health Policy Authority Act. |
6 |
| Section 5. Definition. In this Act, "Authority" means the |
7 |
| Illinois Health Policy Authority. |
8 |
| Section 10. Illinois Health Policy Authority established. |
9 |
| (a) On July 1, 2008, the Illinois Health Policy Authority |
10 |
| is established as an advisory body under the State of Illinois.
|
11 |
| (b) The Authority shall be composed of 5 voting members and |
12 |
| 5 nonvoting, ex officio members. The 5 voting members shall be |
13 |
| appointed as follows:
(1) one member shall be appointed by the |
14 |
| Governor;
(2) one member shall be appointed by the Speaker of |
15 |
| the House of Representatives;
(3) one member shall be appointed |
16 |
| by the Minority Leader of the House of Representatives;
(4) one |
17 |
| member shall be appointed by the President of the Senate;
and |
18 |
| (5) one member shall be appointed by Minority Leader of the |
19 |
| Senate.

| (c) The 5 nonvoting, ex officio members of the Authority |
21 |
| are the Director of Public Health, the Director of Healthcare |
22 |
| and Family Services, the Secretary of Human Services, the |

| Director of Financial and Professional Regulation, and the |
2 |
| Director of Aging.
|

| (d) Voting members of the Authority shall be members of the |
4 |
| general public who have knowledge and demonstrated leadership |
5 |
| in fields including, but not limited to, health care delivery, |
6 |
| health promotion, public health improvement, evidence-based |
7 |
| medicine, insurance, information systems, data analysis, |
8 |
| health care finance, economics, government, and business. No |
9 |
| member of the legislature shall be appointed as a voting member |
10 |
| of the Authority.
|

| (e) The first voting members of the Authority shall be |
12 |
| appointed on or before August 1, 2008.
|
13 |
| (f) The members of the Authority shall meet and organize |
14 |
| annually by electing one member as chairperson, except that the |
15 |
| Governor shall designate the first chairperson of the Authority |
16 |
| from among the first members appointed. The Authority shall |
17 |
| meet at least monthly during the State fiscal year ending June |
18 |
| 30, 2009, and thereafter shall meet not less than once per |
19 |
| calendar quarter.

| (g) Members of the Authority attending meetings of the |
21 |
| Authority, or attending a meeting of a subcommittee of the |
22 |
| Authority authorized by the Authority, shall be paid |
23 |
| subsistence allowances, mileage, and other expenses as |
24 |
| provided by law but shall not receive compensation for their |
25 |
| service on the Authority.

26 |
| (h) The Authority is abolished on July 1, 2014.

| Section 15. Health policy agenda. The Authority shall |

| develop and maintain a coordinated health policy agenda that |
3 |
| combines effective purchasing and administration of health |
4 |
| care with health promotion oriented public health strategies. |
5 |
| The powers, duties, and functions of the Authority are intended |
6 |
| to be exercised to improve the health of the people of Illinois |
7 |
| by increasing the quality, efficiency, and effectiveness of |
8 |
| health care services and public health programs. |
9 |
| Section 20. Reports. The Authority is responsible for the |
10 |
| development of a statewide health policy agenda, including |
11 |
| health care and health promotion components. The Authority |
12 |
| shall report to the legislature at the beginning of the regular |
13 |
| session of the legislature in 2009 and at the beginning of each |
14 |
| regular legislative session thereafter. The Authority's report |
15 |
| to the legislature shall include recommendations for |
16 |
| implementation of the health policy agenda recommended by the |
17 |
| Authority. |
18 |
| Section 25. Rules; contracts; advisory committees. |

| (a) The Authority is authorized to establish policies and |
20 |
| to adopt rules and regulations for the implementation and |
21 |
| administration of the powers, duties, and functions prescribed |
22 |
| for or transferred to the Authority as provided by law.

| (b) The Authority may enter into contracts as may be |

| necessary to perform the powers, duties, and functions of the |
2 |
| authority and as provided by law. As provided by this Act or as |
3 |
| otherwise provided by law, the Authority may enter into |
4 |
| contracts with other State agencies or with local governmental |
5 |
| entities for the coordination of health care services, |
6 |
| including care and prevention programs and activities, and |
7 |
| public health programs.
|

| (c) The Authority may appoint advisory committees as deemed |
9 |
| necessary by the Authority. The advisory committees shall |
10 |
| consult with and advise the Authority regarding the matters |
11 |
| referred to them by the Authority.
|
12 |
| Section 99. Effective date. This Act takes effect upon |
13 |
| becoming law.
