2 | AMENDMENT NO. ______. Amend House Bill 578 by replacing | ||||||
3 | everything after the enacting clause with the following:
| ||||||
4 | "Section 1. Short title. This Act may be cited as the | ||||||
5 | Plastic Bag Recycling Act. | ||||||
6 | Section 5. Definitions. As used in this Act: | ||||||
7 | "Consumer" means any person who makes a purchase at retail | ||||||
8 | for any purpose other than resale. | ||||||
9 | "Distributing plastic bags to consumers" means the act of a | ||||||
10 | retailer giving to a consumer a plastic bag to store or | ||||||
11 | transport goods purchased at retail. | ||||||
12 | "Plastic bag" means any plastic, latex, or polypropylene | ||||||
13 | bag. | ||||||
14 | "Purchase at retail" means the acquisition of the ownership | ||||||
15 | of or title to tangible personal property through a sale at | ||||||
16 | retail. |

1 | "Retailer" means a person engaged in the business of
making | ||||||
2 | sales at retail that owns or controls more than 10,000 square | ||||||
3 | feet of retail space in Lake County. | ||||||
4 | Section 10. Recycling pilot program in Lake County. | ||||||
5 | (a) Within 90 days after the first meeting of the Plastic | ||||||
6 | Bag Recycling Task Force created in Section 15 of this Act, the | ||||||
7 | Task Force shall promulgate procedures and guidelines | ||||||
8 | implementing a voluntary plastic bag recycling program for | ||||||
9 | retailers in Lake County. The Environmental Protection Agency | ||||||
10 | shall administer the program under the procedures and | ||||||
11 | guidelines adopted by the Task Force. | ||||||
12 | Beginning August 1, 2007, retailers, as defined by Section | ||||||
13 | 5 of this Act, participating in the pilot program and | ||||||
14 | distributing plastic bags to consumers free of charge as part | ||||||
15 | of a purchase at retail may: | ||||||
16 | (1) implement a plastic bag collection program that | ||||||
17 | facilitates the return and recycling of plastic bags | ||||||
18 | distributed to consumers by that retailer; | ||||||
19 | (2) provide a clearly marked receptacle for the | ||||||
20 | collection of plastic bags that is in a convenient location | ||||||
21 | for that retailer's consumers; and | ||||||
22 | (3) arrange for the pick-up, transport, and recycling | ||||||
23 | of plastic bags deposited in the collection receptacles by | ||||||
24 | consumers. | ||||||
25 | (b) In meeting the program guidelines, retailers may work |

1 | individually or as part of a group.
| ||||||
2 | Section 15. Task force. | ||||||
3 | (a) Within 90 days after the effective date of this Act, | ||||||
4 | the Plastic Bag Recycling Task Force shall be created and shall | ||||||
5 | conduct a meeting. The Task Force shall consist of one | ||||||
6 | legislator appointed by each of the following: the President of | ||||||
7 | the Senate, the Minority Leader of the Senate, the Speaker of | ||||||
8 | the House of Representatives, and the Minority Leader of the | ||||||
9 | House of Representatives, and one representative from each of | ||||||
10 | the following: | ||||||
11 | (1) a grocery retailer; this representative shall be | ||||||
12 | selected by a statewide association exclusively | ||||||
13 | representing retailers; | ||||||
14 | (2) a retail pharmacy; this representative shall be | ||||||
15 | selected by a statewide association exclusively | ||||||
16 | representing retailers; | ||||||
17 | (3) a general merchandise retailer; this | ||||||
18 | representative shall be selected by a statewide | ||||||
19 | association exclusively representing retailers; | ||||||
20 | (4) a plastic film recycler; | ||||||
21 | (5) an entity operating as a recycling operator of | ||||||
22 | material recovery facilities receiving material from Lake | ||||||
23 | County; this entity shall be agreed upon by a | ||||||
24 | representative of the statewide association exclusively | ||||||
25 | representing retailers and a representative of the Solid |

1 | Waste Agency of Lake County; | ||||||
2 | (6) a national waste hauler operating in Lake County | ||||||
3 | appointed by a national group representing solid waste | ||||||
4 | management entities; | ||||||
5 | (7) the Solid Waste Agency of Lake County; | ||||||
6 | (8) the State Chamber of Commerce; | ||||||
7 | (9) the Sierra Club of Lake County; | ||||||
8 | (10) the Chicago Recycling Coalition; | ||||||
9 | (11) the Illinois Environmental Protection Agency; and | ||||||
10 | (12) the Lake County Board. | ||||||
11 | The Task Force shall meet at least twice per year. The Task | ||||||
12 | Force shall choose a chairperson from its membership. The | ||||||
13 | chairperson shall facilitate the meetings of the Task Force. | ||||||
14 | (b) On or before January 1, 2011, the Task Force, in | ||||||
15 | collaboration with the Environmental Protection Agency, shall | ||||||
16 | compile and submit a report to the Governor, the President of | ||||||
17 | the Senate, the Minority Leader of the Senate, the Speaker of | ||||||
18 | the House of Representatives, and the Minority Leader of the | ||||||
19 | House of Representatives, discussing the following: | ||||||
20 | (1) enrollment in the program; | ||||||
21 | (2) costs to the environment, retailers, residents of | ||||||
22 | Lake County; | ||||||
23 | (3) cost-benefit analysis of the program; and | ||||||
24 | (4) any burden suffered as a result of the program. | ||||||
25 | Section 90. Repealer. This Act is repealed June 1, 2011.".
