Amends the Department of Transportation Law of the
Civil Administrative Code of Illinois. Provides that in addition to the regular reporting requirements of the Act, all public transit agencies that receive State funding shall submit: (i) to biannual State financial and performance audits, (ii) to the Illinois General Assembly an annual Service Plan to increase and enhance service to low-income communities, (iii) certain details of any proposed or ongoing capital improvements receiving State funding where work has been approved or authorized by the public transit agencies. Requires the Regional Transportation Authority (RTA), the Chicago Transit Authority (CTA), the Commuter Rail Board (Metra), and the Suburban Bus Board (Pace) to submit "Service Performance Reports" by route or line compiled in a single report covering FY2000 through FY2006, and thereafter annually. Specifies the information to be contained in these Service Performance Reports. Provides that each public transit agency outside of the RTA region shall submit an annual assessment of the public transit needs of its county or transit district, the availability of public transit in its county or transit district, and its capital needs to provide adequate, timely, and efficient service. Requires all public transit agencies that receive State funding for operating or capital costs, or both, to develop and implement a citizen participation process. Requires the Department of Transportation to compile the Service Performance Reports on an annual basis and submit them to the Illinois General Assembly and the Governor. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|
4 |
| Section 5. The Department of Transportation Law of the
|
5 |
| Civil Administrative Code of Illinois is amended by adding |
6 |
| Section 2705-322 as follows: |
7 |
| (20 ILCS 2705/2705-322 new) |

| Sec. 2705-322. Reporting of results and benefits of State |
9 |
| funding for public transit agencies. |
10 |
| (a) In addition to the regular reporting required by this |
11 |
| Act, all public transit agencies that receive State funding |
12 |
| shall submit to biannual State financial and performance |
13 |
| audits. |
14 |
| (b) All public transit agencies that receive State funding |
15 |
| shall submit to the Illinois General Assembly an annual Service |
16 |
| Plan to increase and enhance service to low-income communities. |
17 |
| (c) All public transit agencies shall report details of any |
18 |
| proposed or ongoing capital improvements receiving State |
19 |
| funding for which work has been approved or authorized, |
20 |
| including for each project: |
21 |
| (1) total cost of the project; |
22 |
| (2) contribution from the total cost from other State |
23 |
| programs; |

| (3) contribution to the total cost from federal |
2 |
| sources; |
3 |
| (4) contribution to the total cost from local and other |
4 |
| resources; |
5 |
| (5) actual annual expenditures, and actual |
6 |
| expenditures and obligations required through FY2010; and |
7 |
| (6) actual or expected completion date.

| (d) The Regional Transportation Authority (RTA), the |
9 |
| Chicago Transit Authority (CTA), the Commuter Rail Board |
10 |
| (Metra), and the Suburban Bus Board (Pace) shall submit the |
11 |
| following information by route or line, on a quarterly basis |
12 |
| unless otherwise specified, compiled in a single report |
13 |
| covering FY2000 through FY2006, and thereafter annually, |
14 |
| hereinafter referred to as "Service Performance Reports": |
15 |
| (i) On-time performance: the percentages of trips |
16 |
| arriving at the last stop within 5 minutes of schedule, |
17 |
| with reasons for annulments and the principal causes of |
18 |
| delays. |
19 |
| (ii) Service regularity: the percentage of the actual |
20 |
| intervals between trips that are within plus or minus 50% |
21 |
| of the scheduled interval (for intervals of less than 10 |
22 |
| minutes) or within plus or minus 5 minutes of the scheduled |
23 |
| interval (for intervals of 10 minutes or more). |
24 |
| (iii) Interruption of service: The average distance |
25 |
| between service interruptions; that is, the number of miles |
26 |
| traveled by a vehicle divided by the total number of |

| chargeable "road calls", including mechanical swaps that |
2 |
| interrupt service. |

| (iv) Crowding: one-hour passenger volume per vehicle |
4 |
| at maximum load points at the a.m. and p.m. rush period. |
5 |
| (v) Capacity utilization: daily passenger load divided |
6 |
| by the rated capacity of the vehicles for the a.m. and p.m. |
7 |
| peaks, mid-days, evenings, Saturdays, and Sundays. |
8 |
| (vi) Speeds of buses and trains. |
9 |
| (vii) Cleanliness of vehicle interiors. |
10 |
| (viii) Absence of heat or air conditioning and water |
11 |
| leaks. |
12 |
| (ix) Crime statistics. |
13 |
| (x) Homeland security preparedness plan and budget, |
14 |
| reported annually. |
15 |
| (xi) Status of compliance with the Americans with |
16 |
| Disabilities Act by rail lines and, for buses, by the |
17 |
| garage out of which bus routes operate, with respect to |
18 |
| frequency, adequacy, and timeliness, reported annually. |
19 |
| (xii) An annual assessment of service provided by area |
20 |
| served, such as community area or municipality, by the |
21 |
| public transit service board with respect to frequency of |
22 |
| items (i) through (x). |
23 |
| (xiii) An annual assessment of the service connections |
24 |
| between routes of the CTA, Metra, and Pace; and an annual |
25 |
| assessment of fare coordination between the CTA, Metra, and |
26 |
| Pace. |

| (xiv) On-time performance and timeliness of |
2 |
| paratransit service. |
3 |
| (xv) The hours of service on each route and the |
4 |
| additional cost to provide earlier, later, or more frequent |
5 |
| service on the existing route, reported on an annual basis; |
6 |
| and the net change in hours of service and costs when |
7 |
| service plan changes are proposed.
|
8 |
| (e) Each public transit agency outside of the RTA region |
9 |
| shall submit an annual assessment of the public transit needs |
10 |
| of its county or transit district, the availability of public |
11 |
| transit in its county or transit district, and its capital |
12 |
| needs to provide adequate, timely, and efficient service. |
13 |
| (f) Citizen participation. All public transit agencies |
14 |
| that receive State funding for operating or capital costs, or |
15 |
| both, shall develop and implement a citizen participation |
16 |
| process that at a minimum establishes the following rules: |
17 |
| (i) for changing bus or rail services, or both, within |
18 |
| a district: at least one public hearing, scheduled with a |
19 |
| minimum public notice of 30 days, that includes disclosure |
20 |
| to the public of the details of proposed service changes, |
21 |
| including the hours of service on each route and the |
22 |
| additional cost to provide earlier, later, or more frequent |
23 |
| service on the existing route, reported on an annual basis; |
24 |
| and the net change in hours of service and costs when |
25 |
| service plan changes are proposed; |
26 |
| (ii) service planning: at least 2 public meetings |

| annually to elicit public input on transit service planning |
2 |
| and feedback on current route configurations; |
3 |
| (iii) operating and capital budget development: at |
4 |
| least 3 public hearings annually on the next year's |
5 |
| proposed operating and capital budgets. |
6 |
| (g) Compilation of reports from public transit agencies. |
7 |
| The RTA, CTA, Metra, and Pace shall submit their 5-year |
8 |
| FY2000-FY2005 Service Performance Reports to the Illinois |
9 |
| Department of Transportation no later than September 30, 2007, |
10 |
| and the Department of Transportation shall compile all reports |
11 |
| and submit them to the Illinois General Assembly and the |
12 |
| Governor no later than November 1, 2007. Thereafter the |
13 |
| Department of Transportation shall compile all annual Service |
14 |
| Performance Reports supplied by all public transit agencies |
15 |
| that receive State funding and submit that compiled report to |
16 |
| the General Assembly and the Governor by March 30 of any given |
17 |
| year. The Department of Transportation shall also publish the |
18 |
| compiled report as well as individual reports from public |
19 |
| transit agencies on a web site maintained by the Department of |
20 |
| Transportation.

| Section 90. The State Mandates Act is amended by adding |
22 |
| Section 8.31 as follows: |
