SYNOPSIS AS INTRODUCED:
 
60 ILCS 1/30-130

    Amends the Township Code. Changes the definition of inoperable vehicle to include certain motor vehicles that are incapable of being lawfully driven on the highway under their own motor power (now, includes certain motor vehicle that are incapable of being driven under their own motor power). Provides that the definition of inoperable vehicle includes abandoned, discarded, dismantled, and unlicensed vehicles. Effective immediately.

1     AN ACT concerning local government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Township Code is amended by changing Section
5 30-130 as follows:
 
6     (60 ILCS 1/30-130)
7     Sec. 30-130. Inoperable motor vehicles.
8     (a) The electors may by ordinance declare inoperable motor
9 vehicles, whether on public or private property, to be a
10 nuisance and may authorize fines to be levied for the failure
11 of any person to obey a notice from the township stating that
12 the person is to dispose of any inoperable motor vehicles under
13 his or her control. The electors may authorize a law
14 enforcement agency with applicable jurisdiction to remove,
15 after 7 days from the issuance of the township notice, any
16 inoperable motor vehicle or parts of such a vehicle.
17     (b) Nothing in this Section applies to any motor vehicle
18 that is kept within a building when not in use, to an operable
19 historic vehicle over 25 years of age, or to a motor vehicle on
20 the premises of a place of business engaged in the wrecking or
21 junking of motor vehicles.
22     (c) As used in this Section, "inoperable motor vehicle"
23 means any motor vehicle from which, for a period of at least 7

1 days or any longer period of time fixed by ordinance, the
2 engine, wheels, or other parts have been removed, or on which
3 the engine, wheels, or other parts have been altered, damaged,
4 or otherwise treated so that the vehicle is incapable of being
5 lawfully driven under its own motor power on the highway in
6 full accordance with the State of Illinois Vehicle Code. The
7 definition of "inoperable vehicle" includes abandoned,
8 discarded, dismantled, and unlicensed vehicles. "Inoperable
9 motor vehicle" does not include a motor vehicle that has been
10 rendered temporarily incapable of being driven under its own
11 motor power in order to perform ordinary service or repair
12 operations.

14     Section 99. Effective date. This Act takes effect upon
15 becoming law.
