Amends the Illinois Fertilizer Act of 1961. Provides that beginning January 1, 2008, all anhydrous ammonia being stored in this State for agricultural use must contain calcium nitrate in an amount sufficient to inhibit the ability of the anhydrous ammonia to be used in the production of methamphetamine. Provides that the Department of Agriculture must adopt rules for the administration and enforcement of the Section. Effective immediately.

| AN ACT concerning agriculture.
|

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Illinois Fertilizer Act of 1961 is amended |
5 |
| by adding Section 18b as follows: |
6 |
| (505 ILCS 80/18b new) |

| Sec. 18b. Calcium nitrate in anhydrous ammonia. Beginning |
8 |
| January 1, 2008, all anhydrous ammonia being stored in this |
9 |
| State for agricultural use must contain calcium nitrate in an |
10 |
| amount sufficient to inhibit the ability of the anhydrous |
11 |
| ammonia to be used in the production of methamphetamine. |
12 |
| The Department must adopt rules for the administration and |
13 |
| enforcement of this Section.

| Section 99. Effective date. This Act takes effect upon |
15 |
| becoming law.
