1 | AMENDMENT TO HOUSE BILL 311

2 | AMENDMENT NO. ______. Amend House Bill 311, AS AMENDED, | ||||||
3 | with reference to page and line numbers of House Amendment No. | ||||||
4 | 1, on page 10, lines 13 and 14, by deleting "through the | ||||||
5 | regulations outlined by the Board"; and

6 | on page 12, immediately below line 8, by inserting the | ||||||
7 | following: | ||||||
8 | "Section 75. No rulemaking. Notwithstanding any other | ||||||
9 | rulemaking authority that may exist, neither the Governor nor | ||||||
10 | any agency or agency head under the jurisdiction of the | ||||||
11 | Governor has any authority to make or promulgate rules to | ||||||
12 | implement or enforce the provisions of this Act. If, however, | ||||||
13 | the Governor believes that rules are necessary to implement or | ||||||
14 | enforce the provisions of this Act, the Governor may suggest | ||||||
15 | rules to the General Assembly by filing them with the Clerk of |

1 | the House and Secretary of the Senate and by requesting that | ||||||
2 | the General Assembly authorize such rulemaking by law, enact | ||||||
3 | those suggested rules into law, or take any other appropriate | ||||||
4 | action in the General Assembly's discretion. Nothing contained | ||||||
5 | in this Act shall be interpreted to grant rulemaking authority | ||||||
6 | under any other Illinois statute where such authority is not | ||||||
7 | otherwise explicitly given. For the purposes of this Act, | ||||||
8 | "rules" is given the meaning contained in Section 1-70 of the | ||||||
9 | Illinois Administrative Procedure Act, and "agency" and | ||||||
10 | "agency head" are given the meanings contained in Sections 1-20 | ||||||
11 | and 1-25 of the Illinois Administrative Procedure Act to the | ||||||
12 | extent that such definitions apply to agencies or agency heads | ||||||
13 | under the jurisdiction of the Governor."; and | ||||||
14 | on page 12, line 10, by changing "2008" to "2009".
