Synopsis As Introduced
Amends the Illinois Vehicle Code. Creates the offense of infliction of serious physical injury or death to a vulnerable user of a public way. Provides that a person commits the offense of infliction of serious physical injury or death to a vulnerable user of a public way if the person (i) operates a vehicle upon a highway in this State in a careless or reckless manner and (ii) causes serious physical injury or death to a vulnerable user of a public way. Provides that infliction of serious physical injury or death to a vulnerable user of a public way is a Class A misdemeanor and carries a minimum fine of $12,500. Provides that any driver who is convicted of infliction of serious physical injury or death to a vulnerable user of a public way is subject to suspension of his or her driving privileges.

Adds a person operating a motorcycle to the definition of "vulnerable user of a public way".

Replaces everything after the enacting clause. Amends the Criminal Code of 1961. Provides that a person also commits reckless conduct who, while operating a motor vehicle, causes bodily harm to or endangers the bodily safety of a vulnerable user of the public way if he or she performs recklessly the acts that cause the harm or endanger safety, whether they otherwise are lawful or unlawful. Provides that reckless conduct is also committed when a person who, while operating a motor vehicle, causes great bodily harm or permanent disability or disfigurement to a vulnerable user of the public way if he or she performs recklessly the acts that cause the harm, whether they otherwise are lawful or unlawful. Defines "vulnerable user of the public way". Establishes penalties for violations.

House Amendment No. 1
Adds reference to:
720 ILCS 5/9-3from Ch. 38, par. 9-3

Replaces everything after the enacting clause. Amends the Criminal Code of 1961. Provides that in cases involving reckless homicide in which a person or persons were killed as a result of the defendant's reckless operation of a motor vehicle on a roadway and the victim or victims of the offense were vulnerable users of a public way, the penalty shall be a Class 2 felony and is subject to a maximum fine of $10,000. Provides that reckless conduct causing bodily harm to or endangering the bodily safety of an individual in which the person injured or the persons whose safety was endangered was a vulnerable user of a public way and the person who caused the injury or who endangered the safety of another person was operating a motor vehicle upon a roadway is a Class 4 felony and is subject to a maximum fine of $10,000. Defines "vulnerable user of a public way". Effective immediately.
