Synopsis As Introduced
Amends the Children and Family Services Act. Provides that the Department of Children and Family Services shall work with representatives of voluntary residential services providers to develop a performance-based contract model that fully funds the cost of care provided by residential services providers beginning in State fiscal year 2010. Provides that on and after July 1, 2008, the Department shall work with other State agencies that require residential services for children in their care, including but not limited to the Department of Human Services, the Department of Juvenile Justice, and the Illinois State Board of Education, to develop program requirements and rates that are not less than the performance-based rates set by the Department of Children and Family Services. Effective July 1, 2008.

Senate Floor Amendment No. 1
Provides that the requirement that the Department of Children and Family Services work with representatives of voluntary residential services providers to develop a performance-based contract model is subject to appropriation.

House Amendment No. 1
Provides that neither the Governor nor any agency or agency head under the jurisdiction of the Governor has any rulemaking authority under the amendatory Act, but that the Governor may suggest rules by filing them with the General Assembly and requesting that the General Assembly authorize such rulemaking by law, enact the suggested rules into law, or take other appropriate action in the General Assembly's discretion.

House Amendment No. 2
Replaces everything after the enacting clause. Amends the Children and Family Services Act. Provides that the Department of Children and Family Services shall work with representatives of residential services providers with which the Department contracts for residential services and with representatives of other State agencies that purchase comparable residential services from agencies for which the Department has rate-setting authority to develop a performance-based model for these residential services. Provides that the rate paid by the other State agencies for comparable residential services shall not be less than the performance-based rates set by the Department. Provides that the performance-based model to be developed shall include required program components and a rate-setting methodology that incorporates the reasonable costs of the required program components, subject to certain provisions of the Illinois Administrative Code. Provides that subject to appropriation of required funding, the Department shall purchase performance-based residential services beginning July 1, 2009. Defines "residential services".
