Synopsis As Introduced
Amends the Criminal Code of 1961. Provides that the offense of unauthorized bringing of contraband into a penal institution by an employee includes knowingly and without authority bringing or attempting to bring or causing or permitting another person to bring any listed form of contraband into the penal institution (rather than just alcoholic liquor, a controlled substance, methamphetamine, or a hypodermic syringe).

Senate Committee Amendment No. 1
Provides that for the purpose of the offense of unauthorized bringing of contraband into a penal institution by an employee or the offense of unauthorized possession of contraband in a penal institution by an employee, the defendant must intend to provide the cellular telephone or cellular telephone battery to any inmate in a penal institution, or to use the cellular telephone or cellular telephone battery at the direction of an inmate or for the benefit of any inmate of a penal institution. Also provides that for such violations involving alcoholic liquor, weapons, firearms, firearm ammunition, tools to defeat security mechanisms, cutting tools, and electronic contraband, such items shall not be considered to be in a penal institution when they are secured in an employee's locked, private motor vehicle parked on the grounds of a penal institution.

Governor Amendatory Veto Message
Recommends that weapons, firearms, firearm ammunition, tools to defeat security mechanisms, and cutting tools that are secured in an employee’s locked, private motor vehicle parked on the grounds of a penal institution be removed from a list of items that are not to be considered to be in a penal institution for purposes of the offenses of (i) unauthorized bringing of contraband into a penal institution by an employee and (ii) unauthorized possession of contraband in a penal institution by an employee.
