Synopsis As Introduced
Amends the Public Construction Bond Act. Requires surety bonds on public construction projects costing over $100,000 (now, over $5,000). With respect to bonds securing contracts between the Capital Development Board or a public institution of higher education and a contractor, requires that within 15 days after notice to the surety that the principal is in default, the surety must (i) complete the work using a contractor selected jointly with the obligee or (ii) provide the obligee the amount needed to complete the work, in excess of the unpaid contract balance and up to the penal sum of the bond. Effective immediately.

Senate Floor Amendment No. 1
Deletes everything after the enacting clause. Reinserts Senate Bill 1890 as introduced with the following changes: with respect to the threshold value of projects requiring surety bonds, makes the threshold for State projects over $50,000 (now, over $5,000) and maintains the threshold for a political subdivision's projects at over $5,000. Effective immediately.

House Amendment No. 1
Deletes everything after the enacting clause. Reinserts the provisions of the engrossed bill with the following changes: During the 15 working days after receiving the default notice, permits the surety to advise the State or political subdivision that it needs more time to investigate and select a course of action. Limits that additional time to 30 working days, unless otherwise agreed to by the purchasing agency. Permits the State or political subdivision to continue the work until the completing contractor is prepared to commence performance if (i) the surety needs the additional time to investigate and select a course of action or the surety elects to use a completing contractor that is not prepared to commence performance within 15 working days after receipt of the default notice and (ii) the State or political subdivision determines that it is in the best interest of the State to maintain work progress (now, permits the State or political subdivision to continue work until the completing contractor is prepared to commence performance if the State or political subdivision determines that it is in the best interest of the State to maintain work progress). Effective immediately.
