Synopsis As Introduced
Amends the Community Services Act. Changes references from "disabled person" to "person with a disability". Provides that a shift from State-provided services to community services should be acknowledged by the State as a clear priority in policies and funding that values community services and supports for persons who choose to live and work in those settings, with the needed resources following the individual. Requires the Governor to appoint a commission by July 1, 2007, or as soon thereafter as possible, to prioritize a strategy for identifying a stream of revenue to address gaps and prioritize use of that revenue on rates and reimbursements for community services and supports. Provides that the commission shall have representation from the Department of Human Services, the General Assembly, persons with disabilities and mental illness, community providers, and trade associations. Provides that the rate and reimbursement methodologies must reflect the cost of providing services and supports, recognize individual disability needs, and consider geographic differences, transportation costs, required staffing ratios, and mandates not currently funded. Makes other changes. Effective immediately.

Senate Committee Amendment No. 1
Provides that community residential alternatives to institutional settings include Intermediate Care Facilities for the Developmentally Disabled and Long Term Care for Under Age 22 facilities. Deletes a reference to State policies in connection with the shift from services provided in State-operated facilities to services provided through community programs. Deletes a reference to "the needed resources following the individual". Provides that the commission appointed by the Governor shall have representation from unions.

Deletes the changes made to Sections of the Community Services Act concerning the purpose of the Act and the Community Services System.

House Amendment No. 2
Replaces provisions concerning appointment of a commission in relation to financing for community services. Provides that the Governor shall create a commission by July 1, 2007, or as soon thereafter as possible, to review funding methodologies, identify gaps in funding, identify revenue, and prioritize use of that revenue for community developmental disability services, mental health services, alcohol and substance abuse services, rehabilitation services, and early intervention services (instead of appoint a commission to prioritize a strategy in relation to community services and supports). Specifies 13 voting members of the commission and 3 ex-officio, non-voting members. Provides that funding methodologies must reflect economic factors inherent in providing services and supports (instead of providing that rate and reimbursement methodologies must reflect the cost of providing services and supports).

Governor Amendatory Veto Message
Provides that the Governor shall create a committee (instead of a commission) by January 31, 2008 (instead of July 1, 2007) to address reimbursement rates for Waiver services to persons with developmental disabilities, and makes changes in the committee's duties. Adds 3 persons with a developmental disability and 3 family members or guardians of persons with developmental disabilities as voting members of the committee, and deletes as a committee member one person from a union that represents employees of providers that serve people with developmental disabilities; deletes references to persons with mental illness in connection with committee membership. Adds the Director of the Department of Human Services' Division of Developmental Disabilities as a nonvoting committee member. Provides that the committee's final report shall be issued by the Secretary of Human Services. Makes changes concerning the committee's recommendations regarding funding methodologies. Makes other changes.
