Synopsis As Introduced
Amends the Emergency Medical Services (EMS) Systems Act. Provides that the Department of Public Health shall issue an annual Freestanding Emergency Center (FEC) license to any facility that is located: (A) in a municipality with a population of 75,000 or fewer inhabitants; (B) within 15 miles of the hospital that owns or controls the FEC; and (C) within 20 (instead of 10) miles of the Resource Hospital affiliated with the FEC as part of the EMS System. (Deletes a provision concerning location in a municipality that has a hospital that has been providing emergency services but is expected to close by the end of 1997 and in a county with a population of more than 525,000.) Requires the Illinois Health Facilities Planning Board to waive a certificate of need or permit requirement for any proposed FEC that, no later than June 30, 2009 (instead of as of the effective date of an amendatory Act of 1996), meets certain criteria for providing comprehensive emergency treatment services. Deletes a requirement that the facility must have participated in the demonstration program in order to be issued an annual license. Effective immediately.

Senate Committee Amendment No. 1
Provides that the Department of Public Health shall issue an annual Freestanding Emergency Center (FEC) license until June 30, 2009. Provides that to be eligible for a license, a facility must be within 20 (instead of 15) miles of the hospital that controls the FEC. Removes a requirement that a facility submit a copy of a certificate of need or other permit issued by the Illinois Health Facilities Planning Board (IHFPB). Provides that an application prescribed by the IHFPB shall be filed with the Board in order that the Board may determine whether an applicant has met all the criteria set forth in the FEC provisions. Provides that the application shall be scheduled for hearing for approval within 45 days after being declared complete and that if approval is given, a Certificate of Approval shall be issued and a copy forwarded to the licensure division of the Department of Public Health within 7 business days.

Replaces everything after the enacting clause. Amends the Illinois Health Facilities Planning Act; provides that no person shall construct, modify, or establish a freestanding emergency center in Illinois, or acquire major medical equipment or make capital expenditures in relation to such a facility in excess of the capital expenditure minimum, without first obtaining a permit from the Illinois Health Facilities Planning Board in accordance with criteria, standards, and procedures adopted by the Board for freestanding emergency centers that ensure the availability of and community access to essential emergency medical services. Amends the Emergency Medical Services (EMS) Systems Act. Provides that the Department of Public Health has the authority and responsibility to evaluate the capacity and performance of any freestanding emergency center established under the Act in meeting emergency medical service needs of the public, including compliance with applicable emergency medical standards and assurance of the availability of and immediate access to the highest quality of medical care possible. In connection with the licensure of freestanding emergency centers, (i) provides for such licensure until June 30, 2009, (ii) makes changes concerning the location of such a center, (iii) requires that such a center submit a copy of the permit issued by the Illinois Health Facilities Planning Board indicating that the facility has complied with the Illinois Health Facilities Planning Act with respect to the health services to be provided at the facility, and (iv) deletes a requirement that the center must have participated in the demonstration program. Effective immediately.
