Synopsis As Introduced
Amends the Public Construction Bond Act. Authorizes the Capital Development Board to waive the requirement of a surety bond for a public construction contract if (i) the contractor is a small business enterprise and (ii) the otherwise required bond amount plus other surety bond amounts waived by the Board from small business enterprises, with respect to projects that are not yet complete, does not exceed $2,000,000. Defines a small business enterprise. Authorizes the Board to adopt implementing rules. Effective July 1, 2007.

Authorizes the Capital Development Board to accept as a surety bond required for a public construction contract a surety bond guaranteed by the federal Small Business Administration or a second party bond if the contractor is a small construction business. Effective July 1, 2007.

House Amendment No. 1
Replaces the Capital Development Board's authority to accept a second party bond as a surety bond with authority to accept a deposit, in an amount at least equal to the contract price, of cash, a letter of credit from a federally insured financial institution, a U.S. debt obligation, or a debt obligation backed by the full faith and credit of the State of Illinois.
