Synopsis As Introduced
Amends the Illinois Insurance Code. Requires the Department of Financial and Professional Regulation to develop appropriate disclosures to be provided to purchasers of identity theft insurance, including what the insured will receive if he or she is a victim of identity theft and how to protect himself or herself from identity theft.

Senate Committee Amendment No. 1
Replaces everything after the enacting clause. Amends the Illinois Insurance Code. Requires the Department of Financial and Professional Regulation to develop an appropriate consumer fact sheet to be provided to consumers, either via the Department's website or by hard copy if requested, regarding identity theft insurance. Provides that the fact sheet shall include at a minimum, information on what is generally covered under identity theft insurance and on how to protect himself or herself from identity theft.

House Amendment No. 1
Deletes reference to:

30 ILCS 805/8.31 new

Deletes everything after the enacting clause. Creates the Identity Protection Act. Prohibits a State or local government agency from using an individual's social security number in certain ways, subject to various exceptions. Requires each State or local government agency to develop and implement an identity protection plan. Provides that any employee of a State or local government agency who intentionally violates the provisions of the Act is guilty of a Class B misdemeanor. Preempts the concurrent exercise of home rule powers. Provides that the Act does not apply to the City of Chicago. Amends the State Mandates Act to require implementation without reimbursement by the State. Effective immediately.

House Amendment No. 2
Deletes everything after the enacting clause. Reinserts the provisions of the bill as amended by House Amendment 1, but deletes a provision that excludes the City of Chicago from the Act. Effective immediately.
