Synopsis As Introduced
Amends the Criminal Code of 1961 relating to the unlawful use of weapons. Prohibits the sale, manufacture, purchase, possession, or carrying of 50 caliber rifles. Provides that a violation is a Class 2 felony, unless the weapon is possessed in the passenger compartment of the a motor vehicle or upon the person, while loaded, in which case a violation is a Class X felony. Exempts: (1) peace officers while in performance of their official duties; (2) wardens, superintendents, and keepers of prisons, penitentiaries, jails, and other institutions for the detention of persons accused or convicted of an offense; (3) members of the Armed Services or Reserve Forces of the United States or the Illinois National Guard, while in the performance of their official duty; and (4) persons licensed under federal law to manufacture those weapons. Provides that the provision prohibiting the sale, manufacture, purchase, possession, or carrying of 50 caliber rifles does not apply to a person that possesses a 50 caliber rifle before the effective date of the amendatory Act. Provides that such person shall only be allowed to transfer a 50 caliber rifle to a dealer licensed as a federal firearms dealer on or after the effective date of the amendatory Act.

Replaces everything after the enacting clause. Amends the Criminal Code of 1961. Provides that 90 days after the effective date of this amendatory Act, it is unlawful for any person within this State to knowingly manufacture, deliver, sell, purchase, or possess or cause to be manufactured, delivered, sold, purchased, or possessed any .50 caliber rifle or .50 caliber cartridge. Provides that these provisions do not apply to a person who possessed a prohibited weapon before the effective date of the amendatory Act if the person has provided proof of ownership to the Department of State Police within 90 days after the effective date of the amendatory Act. Provides that on or after the effective date of the amendatory Act, such person may transfer such weapon only to an heir, an individual residing in another state maintaining that weapon in another state, or a dealer licensed as a federal firearms dealer. Specifies penalties for violations. Provides exemptions. Provides that the provisions of the Act are severable. Effective immediately.

Senate Floor Amendment No. 2
Provides that the definition of antique firearm is as defined in the Code of Federal Regulations (rather than as defined in the federal Gun Control Act of 1968). Deletes provision that requires a person who possessed the .50 caliber rifle or .50 caliber cartridge before the effective date of the amendatory Act to provide proof of ownership to the Department of State Police within 90 days after the effective date of the amendatory Act in order to be exempt from violating the amendatory Act.

 The total impact of SB 1471 (S-AM 2) would result in an increase of 10 inmates, with additional operating costs of $1,949,700 and construction costs of $584,800 over ten years.
