Synopsis As Introduced
Amends the Private Detective, Private Alarm, Private Security, and Locksmith Act of 2004. Provides for the regulation of canine handlers through the issuance of canine handler authorization cards and the regulation of canine trainers through the issuance of canine trainer authorization cards issued by the Department of Financial and Professional Regulation. Provides for the licensure as private detectives and private security contractors, without examination, of any person who has been providing canine odor detection services since January 1, 2005. Changes the membership of the Private Detective, Private Alarm, Private Security, and Locksmith Board from 11 members to 13 by adding one licensed private detective who provides canine odor detection services and one licensed private security contractor who provides canine odor detection services. Makes other changes. Amends the Animal Welfare Act to exempt private detective agencies and private security agencies licensed under the Private Detective, Private Alarm, Private Security, and Locksmith Act of 2004 that provide guard dog or canine odor detection services from the Act. Effective January 1, 2008.

Senate Committee Amendment No. 1
Exempts from the Private Detective, Private Alarm, Private Security, and Locksmith Act of 2004 a person who provides canine odor detection services to a unit of federal, State, or local government on an emergency call-out or volunteer basis and does not receive any compensation or remuneration for such services (instead of on an emergency call-out or volunteer and not-for-hire basis). In the provisions concerning the qualifications for licensure as a private detective and private security contractor, provides that the provisions allowing licensure without examination for persons who have been providing canine odor detection services for hire since January 1, 2005 applies to those who submit a completed application to the Department on or after January 7, 2008, but before January 12, 2008 (instead of just those who submit a completed application). Adds provisions concerning the subcontracting of canine odor detection services, the employment of canine handlers in a temporary capacity, and additional canine handler training hours. Allows a person who has been engaged in the provision of canine trainer services since January 1, 2005 to obtain a canine trainer authorization card upon the submission of a completed application, the payment of applicable fees, and the satisfactory demonstration to the Department of evidence for the provision of such services. Makes other changes.

Deletes everything after the enacting clause. Reinserts the provisions of the engrossed bill with the following changes. Amends the Massage Licensing Act to provide for the licensure of an individual who failed to apply for licensure under the grandfathering provision of the Act within the time period specified, but who meets certain conditions and otherwise meets the qualifications of the provision, provided that the individual submits a completed application for licensure within 10 days after the effective date of the amendatory Act. Further amends the Private Detective, Private Alarm, Private Security, and Locksmith Act of 2004. Changes the short title to the Private Detective, Private Alarm, Private Security, Fingerprint Vendor, and Locksmith Act of 2004 and makes conforming changes in various other Acts. Adds provisions to the Act requiring the licensure of fingerprint vendors (persons that offer, advertise, or provide services to fingerprint individuals, through electronic or other means, for the purpose of providing fingerprint images and associated demographic data to the Department of State Police for processing fingerprint based criminal history record information inquiries). Replaces references to "firearm authorization card" with "firearm control card" throughout the Act and makes corresponding changes in the Criminal Code of 1961. Adds a provision concerning continuing education for licensees. Provides for the imposition of a civil penalty in an amount not to exceed $10,000 (instead of $5,000) for each offense of unlicensed practice or fraud in obtaining a license. Makes changes to the composition of the Private Detective, Private Alarm, Private Security, Fingerprint Vendor, and Locksmith Board. Preempts home rule powers. Makes other changes. Effective immediately.
